Anna emailed me earlier as I have been chasing her regarding the new contracts that some people have received on the forum. She stated I do not need a new one and people had received new contracts as Ambasun had void them??
She is still claiming I havent paid solicitors fee and is refusing to represent me, however she sent me the new contract as we switched apartments in the early stages. I have asked her why would she do this if she hadnt had payment. She is useless to be honest and I have still not paid my final payment over due now from 1/12/08.
Nadya emailed me to say Ambasun had not transfered €15k of our money to the developer, yet Anna states all had been received except her solicitors fee. what an absolute mess. I dont know about you but I would like to get watchdog involved and maybe ask a large international paper to take up the story and that may jolt a few of these idiots to rectify things. In summary it can be classed as theft as we have paid our money and for some reason it is now missing. what do you think??
Mark08- Anna says she or the developer hasnt signed my contract - Ambasun UK have so if you are the same, surely we can claim all monies back from Ambasun if we did not proceed as we have apparently no ties with the developer?0 -
HI Rianne
How can your contract be binding if the developer has not signed it.Anna says your contract is signed by Ambasun and they have nothing to do with the developer now.It would appear Anna wants it all ways as long as the developer gets his money. She wont stand by my original contract and I believe thats because the developer would have to furnish the apartment. If your contract is ok signed by ambasun then why not mine.It would be intresting to know if our contracts are the same and signed by the same person. Thanks for the information
Kind regards
Mark08

to rianna mark8 do you think we should get watchdog involved to see if they can sort things out its worth a try0
-
I think Watchdog would be a good idea. I made the same suggestion last month. had a look at their website and easy to do. would others be interested??0

Hi Rianna
You would seem to be in the same position as ourselves. We also recieved an e-mail from Nadya 0n the 17/12/08 saying all money has not been recieved. We also have conformation from Anna saying all money has been recieved and forwarded to the developer through her accountant.
Anna has told us we do not have a binding contract with the developer but makes no mention of getting our money back.I have contacted Ambasun uk for answers but no Directors in work until the 5/01/09.What I want is answers from them and Anna and then if no joy it will leave one option for me,Legal proceedings.
It does seem strange that you dont need a new contract, when ours is not legal because signed by Ambasun uk.Everyone involved are just giving us the run around trying to get more money from us all.IT really is time we all got together and forced the issue with all involved.Watchdog is a good idea but could take some time, that said we have time to get this right if possible.
Keep intouch with any updates, lets see what the new year brings.

hi mark08,
i think both watchdog and legal proceedings would be a good options. as legal proceeding can be costly would it be better to do it as one case for us all or many independent ones? at least we could all share the cost and would be alot less expensive individually(i also bought in albatros). small claims court is limited at 5k. so we would have to go the full wack. and i know through recent experience the costs can run away especially when the other solicitors play hard ball. what do you think??0 -
I cannot understand why so many of you want to consider legal action which is expensive and almost certainly pointless, when for about £200 any of you could get a cheap deal from a tour operator and spend a whole 7 days in Bansko with flights, transfers and accommodation all paid for, and go and see the situation for yourself!
In that time you can go onsite, try and find and speak to the developer and quite possibly sort out all your problems. And you get a short holiday.
I do predict, however, that starving the developer of money is a sure-fire way to make sure the projects never get finished.
Is this too simple to understand?0
