Where 2 prices are displayed in relation to a product, law states that the lower must be charged. However, strictly speaking Tesco's policy does specify the price on the product or the shelf. Still - I wonder if they'd rather refund under the policy or incur a hefty al' fine from Trading Standards for breaking the law!
BTW I got a Batman DVD and another LB Book refunded tonight without a debate! I've also "debated" that I've been overcharged in the past going by the poster price, and "won".....so I guess that makes me a hypocrite :rotfl:0 -

Not too sure what you mean, but you must be charged the lower of two if they differ, or you've been overcharged.0 -
The desk where you take CDs, DVDs, etc for refund at my local Tesco has the notice that says "overcharge" on it, rather than the one that says "sel or product", so presumably you'd be overcharged if the poster were wrong?
Oh, and another thing: I've recently been told that I wasn't overcharged on a product, because the SEL was wrong and the price I was charged was correct!!!!! Nice try, Mr T.

Hi Folks, I've been browsing for a while and had a couple of Organic Chickens for my trouble - many thanks to all who posted about those, can't believe how long it went on for!
Hubbie went shopping tonight and went for it with the Batman DVD. However, when he went to CS, the woman on there would only refund the difference as he hadn't left the store. As I said, I've been browsing here for sometime, but I haven't seen that excuse yet - was she right or wrong? And should I go back there tomorrow to push for a total R & R?
Help please ...... DH is not happy!!!0 -
She was wrong - he'd paid for the items, they were now his and he'd been overcharged. This is just one of many ruses Mr T is trying to get out of r&r. Bless him.0

Point of sale is where you enter into a contract with tescos, ie when you hand over your dosh at the til.
Therefore it matters not whether you leave the store or not, and they are infringement of their own policy by claiming this.It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.
Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.0 -
picked up a copy of little britain last night. when i went to cs for refund, a very helpful assistant explained (as if i didn't know!) that as it was tesco's fault, it was their policy was to refund the whole amount and i could keep the book!
this was at the stockport extra store.I'm in the £2.00 club! terramundi cracked open Christmas Day £748Started a new one Boxing Day!

He is in terms of the law of contact correct when he say that a price on a SEL, Poster, Product is not a binding price. All these various things are all 'invitations to treat', the binding contractual price occurs at the point of sale, when goods are exchanged for consideration (money, credit card, sommerfield coupons, etc). However, what this manager fails to recognise is that a number of laws applies to the sale of such items. Failure to sell at the lowest advertised price is not a breach under contract law, but is a breach of the Consumer Protection Act. Also failure to adhere to the policy of R&R which states R&R applies is charged more than shelf or product is again a breach of the law. Shelf does not just mean SEL the wording implies within the SHELF ie a poster on the shelf would apply also.
Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:
EVERY LITTLE EXCUSE HELPS in trying to get out of the R&R policy when the law has been broken, especially on high value items.0
