Is this the end for the CD misprices I wonder.

This is very interesting, but I don't quite see how it absolves Tesco of their responsibility. The item is still mispriced, i.e. they are showing a lower price somewhere than the price you are actually charged. The policy states that they will refund you and you keep the item, if they are advertising it at a lower price than you are charged.
Any legal bods here have an opinion on this?
Oh yes, and also, I saw a mispriced book the other day, and when I was getting my refunds for chicken and cheese,, mentioned this to CS (I didn't say what book it was, just wanted to see her reaction). She replied that the books were a franchise and Tesco wasn't bothered about misprices there! So I wonder if that also applies to the CDs etc?

The books are provided by W H Smith. They come pre-priced.
I had this on friday at the Tesco in Denton (the home store one).
I got the Little britain book and the greenday cd. Two assistants on the CS till - I was offered the £1 difference off each as told to the staff member by the entertainment manager.
I pointed out their poster and she told me how they were delivered, and that effectively "it's not their fault".
I said "that's not my fault either".
Then the other CS said something about the customer being right because i'd pointed out the policy.
If tesco cannot be @rsed to remove incorrect stickers then surely that is wanton over-charging, as the shelf replenisher can clearly see that the SEL does not match the sticker.
Also, I am pretty sure that if you are asked to accept something (Like the till flashing "DO YOU AGREE THE PRICE FOR THIS ITEM" YES-NO) they cannot enforce this as you accepting the price of the item, as you do not know the rules behind this question.
In other words you don't know what the reprecussions of saying either yes or no actually are, unless this is diplayed somewhere in store. I think it's more to do with you saying NO and then a staff member coming over and correcting the price manually.
Personally, I always take CDs/ DVDs through a manned till, because then I can argue that it was the fault of the till member not spotting the discrepancy in the prices.It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.
Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.0 -

They maybe trying to avoid R&R on a legal technicality, under the area of contract law, although it does not absolve them of the CPA infringement. The area of contract law is that if you willingly enter a contract for an item lets say it was £9.77 even though another price said it was £7.97, then the contract could be declared null and void, if you try claiming that the agreement was for £7.97. Catch my drift, complicated stuff but it is part of contract law, and could be used to bamboozla many individuals. However, although the contract could be considered null and void, they have still breached the CPA.Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:

its a till prompt call "Price verification" - its been available for years and we use it alot in our store. Its there as an internal check so that pre priced items prices can be verified at the point of sale. The cashier can then override the system price with the pre price on the packaging if the system price is wrong. This check obviously works with the self scan tills too hence the "Do you agree" question.
Books are NOT a franchise, Tesco ARE bothered about misprices, the CS obviously needs a little?! more training.Fight Poverty - Hit a tramp!

If you scan them they accept them no problems(well i have had none anyway).I have collected what must be about 15 books from Somerfield's so now have a nice pile of 50p and £1 vouchers and what must be about £75 in £5's aswell.Take note though the expire at the end of December:)
As i said before i used a few today to get my bill down from £18 to £2 and pretty much the same yesterday:rotfl:
Tesco dont acept these vouchers, the only reason your getting away with it is because a computer can't tell the difference. The member of staff who you dealt with obviously didn't have the correct knowledge. No doubt you'll be ranting about how awful Tesco is when you do get caught.0 -

Also the Confessions of a Manhattan Call Girl book scans at 2.96, so don't bother.0 -

Why do you think i use the self scan tills to use the Somerfield coupons...as i know if i went through a 'manned' till they would refuse them.I'll keep using them until they say i can't don't worry about that;)
I will hardly get 'caught' as you put it i mean they will say oh you're not allowed to use that many coupons or you're not allowed to use Somerfield ones so i'll just use the oh sorry mr i didn't know:D
You know what i might even go in there and see if i can get at least half the price off a DS game for the kids next weekend using the same coupons:DDarren0 -
