I saw this CD in a Tesco near to me and it got me thinking ... until I saw the title.0 -

Nethertheless, the SEL was Misleading. If it was immediately under the item (and there were more than one) that scanned at the higher price, the lower price should have been charged.
The intention of the law is not to ensure that consumers have to study POS material before making a choice to buy something. This is a classic case. CDs titles are often not entirely visible on the album cover and, unless there was a price sticker on the item, the ONLY indication as to the price was the SEL. It's another case that should be referred to Trading Standards, though, as this is probably a genuine mistake, they probably won't inforce the law.0 -
I think thats going a bit far when the sticker wasnt even for that product...
Im still debating a R&R when the SEL was the correct product and the wrong price!0 -

Whilst I can see your argument, the question must be where do you draw the line? The rule must be somewhere along the lines of:
Could a customer easily be mistaken and think that the SEL is for a product other than that that it was placed next to? Even in this case where the OP was hoping to get R&R, they didn't notice that it was for a different product. Therefore if someone is looking hard enough to get an R&R and fails to notice it the fact that the SEL is for something else, there's a damn good chance that any other customer would be equally deceived.0 -

Paranoid mode on - a few minutes later the Security Dude left his monitoring station and went firing off in the general direction of the CDs - Paranoid mode off.
Anyhow, CS lady eventually comes back with SEL and points out that it has the album title of 'Thankful' not 'Breakaway'.
I was stunned 'cause I hadn't noticed this - 'Duh! Okay Fred!'
So I took a refund - and no CD.
Didn't argue.
So I've failed with a R&R............

PS I've had a bummer of a day at work - didn't want the stress of a row - but should I have stood my ground..........? Did I even have any ground to stand on?
Of course you did, it was an employee of Tesco acting as their agent who placed the product, the product was of the correct artist the title different the burdon is on the vendor to make clear the offer and not the consumer to question the bargain! I'm not convinced in that case. The label states the artist and title, so doesn't represent an incorrect price. No guarantee that the staff and not a customer put the cd in that slot.0

Yesss!! Today (23rd) got 2 x L'Oreal Infallible for free (saving 22 quid) -at Tesco Sandhurst (Near Camberley, Surrey). Thanks for alert this thread. There is lots left in this Extra store. (product appears to be only stocked in the Tesco Extra Stores).
At L'Oreal fixture in Sandhurst the Infallible stuff is "hidden" at ground level, the eye level promo is empty. Behind is a handy price check scanner for customer use. If it scans at 10.99 youre on as SEL says 10.94.
No probs at CS, helpfully told me it was an outside Cosmetics company who made this mistake as they are responsible for setting up their own pricing; Tesco would claim the money back from them!
