  • how can KE be allowed to remove our money from our accounts before or after the 8th, or even still now i bet people are taking money out. I kinda wish i wasnt so quick and had left it there to go to ING.

    I would agree with that. You could prove (in court if necessary) that ING (rather than KE) had your money and you want it back. There is someone to sue, in the unlikely event that you had to.

    The concern is with people whose contract was with the legal entity that was KE, as that no longer exists. Of course if ING have acquired the KE business including all its assets and liabilities, then we should still be OK too as we could pursue ING for damages, i.e. our money back. But I am not sure that's the case.

    Hi all,

    I set up a BACS transfer on Monday (6th) for £750 to leave my account tomorrow (10th). I need the money in my current account by the 20th otherwise I won't have enough to pay the rent. What are the chances I'll receive the money on time (or at all!)?

    I agree. Had I known yesterday morning about the pending ING move, I would not have initiated the transfer!
  • Looks like ING are now giving a consistent message;

    "all transations will be honoured from KE accounts although there is a backlog..."

    I asked if their position had changed on this during the morning and was advised that they had received fresh guidance in the last 90 minutes.

    Some hope in this I think?

  • When ING took over KE they will have effectively taken over the liabilities as well as the assets surely - for example, your next monthly interest will be paid for the whole month - not just the time from which ING took over.

    If they accept the liabilites then they also accept responsibility for BACS and CHAPS transfers "in transit" - no matter where they happen to be. There is no legal way that KE could have permanently transferred assets to KSF (without informing us of a novation - which they didn't) - so the money remains the responsibility of KE - now ING.

    At least - that's what I keep telling myself.....

  • but the point id just like to reiterate to all those saying well done to brown and co is they haven't done anything. They have transferred responsibility to Holland if you need to sue anyone your left paddling on your own. On the other hand the business end of what was Ke is fully covered by brown and co. So would you rather have to deal with ING with no UK help or KSF/KE carrying 100% cover?

    Stick me on the list please.

    Set up 2x CHAPS transfers at approx. 14:30 on Tuesday, each for over £32k. One each from mine and my wife's accounts. No sign of money yet and as with the majority of the rest of you the balance is down to £0 in the KE account.

    The great irony is that when I did the first transfer I forgot to leave £20 in the account to pay the CHAPS fee. So I phoned them and agreed with the nice lady that I would pay £20 back in from my linked account by BACS. This arrived in the account today.

    So the system still works. But clearly only when making deposits not withdrawals. (I'm being somewhat flippant here as I believe BACS is entirely automated, whereas CHAPS requires manual intervention so could in theory have a backlog of transactions).
