Thanks for your replies - you've been really helpful. I'm upset by her attitude - 'yes it's broken, but I can't afford to lose out on £40, so you should'. I don't know a single person who can afford to throw away that amount of money! I certainly can't!
I'm not sure what the point of going through the dispute console is, as it suggests we swap messages saying what we both think... That's already clear now. I think she's unreasonable and she thinks I'm unreasonable. We're not going to resolve this by ourselves. If I can open a dispute on day 7, I think that should be tomorrow, and that's what I'll do. This has really put me off buying from eBay again. The seller has lots of feedback (2000+), 100% positive and she's being really stubborn about all this. Edited to say: I've just noticed fallingstar1's comment saying that buyerscan't get negged...? If so, this proves how long ago I last used eBay!0 -
She is not going to willingly give you a refund so the paypal dispute is the only way to go. Sometimes by just opening a dispute this can jolt the seller into giving a refund. If her first reply to the dispute is negative then escalate it. This means you are handing it over to Paypal to make a decision. And yes it's been a while now but sellers can no longer leave buyers negative/neutral feedback. And she's obviously not an ebay novice so should know better than to say it's not her fault.
If you need any help/advice with the paypal dispute please just ask.0 -

In supprt of many sellers i do not think the packageing in general is poor but as seen on panorama the couriers are far from carefull and lets face it if sellers did package to the same level as a large comapny the postage charges would be a little higher than 5-6 quid i always use to get whinged at ooooooh the postage charge is or was high after they bid?? didnt have to bid did they?? in that postage should be a reasonable charge for packageing , i think some think that should be a round the quid mark .0 -

someone who ordered a Wii,with steering wheels,Wii fit,games etc
how do i know what they got?
well the seller decided to use a box way too small and jam the lid down with plain old selotape
thankfully it seemed to all be there when i tried to repair it for them as best i could
the unknown crockery type item sent in a jiffy bag,whatever it is it was bulky and is multiple peices now
the constant amount of items sent in do not bend envelopes which are way too bulky/heavy so the envelope just falls to pieces
people who think a carrier is bag is a militery issue indestructable transportation vessel and many more0 -

No, it's a different seller. Clearly from the same school of thought though.
As for being out of pocket, I am out of pocket by £40. The seller is out of pocket by £8 postage, because the item I bought cost her nothing - it had been sitting in her loft for over a decade. It was an unwanted present. I know this, because she wrote that into her listing. :mad: I'm sure she's made enough profit from the rest of the dinner set to cover that £8.
I have never negged anyone before, but if anyone deserves a big warning label, she does. I've told my parents Paypal gave me the £40 back purely to stop them from worrying. This is why I didn't want them using eBay in the first place - they really don't need the stress. (My dad is recovering from an operation and they both really should take it easy for a bit.)
Anyway, just one day left before kicking off the dispute process. Really not looking forward to it... but I mean, I'm lucky in that I know I can get advice on MSE if it all goes pear shaped!0 -

pinkgem - when they ask you to send it back to the seller in "its original condition" I'm assuming they mean as I received it as thats a little misleading. yeah it would mean as you received it. i presume you started an item significantly not as described claim and stated that the item was damaged when you received it?0
