perhaps we could get back to the point that 3plus1 bought up in first place...what was the item as i believe you are not insured for pottery by post as i sent some before...could be wrong tho..TO FINISH LAST, FIRST YOU HAVE TO FINISH....0

ok enough micky taking on my part,
if it arrived broken and she paid via paypall then she asks the seller for a full refund if he says no then put in a claim via paypall stateing the item was not recieved as described they will freeze the sellers paypall account if he does not issue a refund which im sure he will as it is his problem if the item arrives broke not the buyers problem , if she paid by cheque how ever, different kettle of fish she would have to wright it off then as it would cost to much to persue through the small claims.0 -

The seller has got in touch and said that the people at the Post Office said the item would be covered for up to £35 (I paid £40 inc. postage) and she (turns out it's a she not a he!) wasn't sure if it was her or me who was meant to claim.
Basically, I want my £40 back. However, she does seem nice and I don't want to make things difficult if I don't have to go down that route.
Is it down to her to claim from the Royal Mail? Can she even claim? Someone here said that pottery is not actually covered. It was a piece of tableware that I bought to (ironically!) replace an item in my parents' dinner service that they had broken.
Should I just say she should refund me the £40 via Paypal and the rest is for her to sort out...? (I know the item was a gift in the first place, so it's really only the postage she's lost out on - not the entire £40.) Like her, I'm not sure who is responsible here!0 -
down to the seller to claim,however if its insufficiently packaged then they are less likely to get a payout0

It is up to the seller to make the claim and if as I suspect the item was not sent special delivery then it wouldn't be covered. She should refund you but please be aware that she could insist you send it back to her at your own expense. Hopefully if she's reasonable she will just tell you to dispose of it.0
