Item arrived broken - advice please

    Normal post - but she obtained a certificate of postage. Can she do anything with that?
  • No unfortunately not. She will have to write the £40 off. But at the end of the day that's not your fault. She should have sent by special delivery.

    Yes, absolutely. It is up to the seller to be sure that goods are adequately packed and insured. Make your claim with Paypal and leave it to her to sort out the claiming.
  • speaking from xperiance even if the seller had sent by special delivery parcel force etc take months to sought it out and hope you just forgrt about it ,as for the op just ask for your money back she doent have to send it back unless the selller pays that is if she goes through paypall lets face it the seller is stuffed either way but broke is broke.

    Not true. The seller is entitled to have the item returned to them at the buyer's expense before issuing a refund.

    Would be a bit pedantic of seller to demand it back. Just ask seller if it is OK to hang onto it for postal inspection if required (keep packaging)

    Yes absolutely. My post at #21 was making the OP aware that the seller could ask for it's return. My post at #26 was in response to the lone ranger saying that the OP didn't have to return it.

    sorry you are wrong as an ex power seller on ebay and had my fair share of disputes with buyers , they do not have to pay to send it back if paypall are involved them you have no chance i was told by paypall to refund all costs includeing there bloody postage and paypall say they have seen via pictures the item is damaged this happened to me 6 times out of 3000 items the final straw came when i sent an item valued at £850 it got damaged i think ? as i was never to sure on the buyer as it had happened to them 4 times before in my view they were swapping items the oldest trick in the book out of my 6 disputes 4 were swapped items when I had paid for there return.
    payapll sided with them AGAIN no surprise there i guessed this was the case so removed all funds from my paypall account they paypall tried to issue a refund but couldnt as i had no funds in the paypall account that was 12 months ago and they still ahve not had the refund and i will not give it , i have asked the seller to bring the item to me and i will refund , he will not why?? becouse he swapped mybitem with a broken item and sold mine on at a profit there are loads of scammers on ebay i now have gone back to my shop my own website and local auction house goodbye and good riddence i say.

    I'm having the same problem at the moment with something I bought. The packaging was rubbish and you could clearly see before opening the parcel that it was going to be damaged, plus it rattled and only contained one small item. When I sent a polite email saying it arrived in three pieces I got a reply basically saying "not my problem". I gave one more chance still with no luck, plus an accusation of me breaking it, and then I gave it to PayPal to deal with.

    It is the sellers job to package it correctly and its not too much to ask for a refund or replacement when they've done something wrong.

    some of the packaging i see every day from ebay sellers is shocking
    paypal/eBay list edinburgh addresses in a very unique way so its easy to spot ebay stuff
