I'm not defending them, I was let down too, but let's be realistic, their T&Cs are not as binding as people want to believe. Dell have terrible customer service and handled it badly, but that doesn't make any difference to their legal position. Why waste your valuable time flogging a dead horse? The amount of time some people are putting into this they could get a part time job and earn enough to buy a much nicer tv!0 -

Well each to their own I guess. Some people can't afford a better TV and may need a new one and feel hard done by, some are debating it because of the principal of the matter. Personally I need a new TV and can't afford expensive LCD's, but don't want a giant CRT. I have enough spare time to follow it up too (admitidly not as far as getting in trading standards and small claims courts etc) but if people do and want to then, well it's their choice.0 -
Seems pretty clear to me. The Force Majeur clause specifically says examples include production problems. A lovely vague term that can mean whatever they like. And then it says if delays last longer than 2 months they are free to terminate.
Dell may well be interested in having a blazing row with you over 50 grand, but for this minor consumer matter, they're being as nice as they're going to be, move on.0 -

I've hardly spent much time on this. It took longer to write the comments above then it has writing to Dell. Likewise the small claim forms will only take 30 minutes to complete. So thats 1 hour to save £400 or so. I think thats worthwhile.0 -

I remain unconvinced about patp s comments aswell. I am pursuing this, it is costing me nothing, just a few minutes of my time. By my calculations, I am at least 200 quid out of pocket.
If I didn't know any better I would be tempted to say patp was trying to talk us out of it?Never ever pay full price for anything and question everything at least twice!0 -
I've been waiting for them to tell me if they are building any more, but it seems obvious they're not (Or they will lie to me and send a refurb) so tomorrow if I have not heard anything I am going to be phoning up for a refund

They won't sort anything over Christmas so I need to get the situation solved ASAP. It seems Dell has started the price drop of other LCD TVs anyway (Decent branded ones which I can take back if they go faulty!)0 -

Act of God clauses cover forces outside Dell's control. The fact they haven't ordered more monitors is not an act of God, it was their decision.0 -

I would say to anyone that is fighting for the 32" instead, keep going as they have just done a big uturn on me, I think a bigger force has made them change there mind. Am I sorry I went for the "loss of bargain?" no, as its just a tv for the bedroom so a 32" would just be too big. Happy days, and a Merry Christmas to you all :snow_laug .0
