I'm in the same situation as you Pagan98, but haven't requested judgement yet. Can you tell me how long do you have to wait after requesting judgement and when would you issue a third party debt order against their bank account?
My first claim against them was admitted so I didn't have to go through this process! Any pointers appreciated.
Has anyone else been paid out or had a new phone from them? At least this would prove that they are still trading.0 -
phones2U got my judgement set aside on the basis they paid me back in august which is 100% lie-think this is their new time wasting tactic asthey havent been able to get away with the others! I am now awaiting my hearing to take them to court. I would appreciate it if other people who have judgements/claims against them pm me with their case numbers so i can go to the hearing armed with a list of cases to prove to the judge just how bad this company are at paying people their money.

My Small Claims form goes in to the local Sheriffs Court in northern Scotland today - it'll cost P2UD a lot more to come up here to court than it will just to pay me what they owe me, but I doubt that logic will win with them....

I finally got my last cashback cheque from them in December, deposited it the same day and it has since cleared, so happy about that. It took, however, more than just a kind reminder - I had been emailing them EVERY DAY for about 3 months, reminding them that I would not only take legal action, but also continue to email them every single day until they paid.
The contact form on their website is NOT working any more, but I have also been emailing these people directly, so you can try all these (just CC-them):

They will probably tell you to email claims, as they can not do anything from other departments, but just keep emailing them. Every single day.

I have requested Judgement two days ago and await their response. I have also copies of all the emails i sent them every day for a month and the proof of recorded delivery letters and fax. Will see what happens.0

If your claim was done via MCOL you should be able to see if you have won judgement by logging in to MCOL.0

A LBA is not intended to scare.
It just informs the defendant of the looming action so that they cannot say they are surprised to get a summons.
MCOL is the easiest way to make a claim. As long as no hearing is necessary everything can be done on-line.
If a defence gets lodged, then the case gets transferred out of the MCOL system to your local county court.
Bear in mind that you will have to pay the court fees, and although they will be added to your claim, the court can't guarantee you will be paid by the defendant even if you win the case.0 -

I read on another website they have closed down.
can anyone confirm because I want to take them to small claims court but there is no point if they have closed shop.
Also, has anyone had any successful legal action against Phones 2U?0
