    This thread had become quite unpleasant in places and at the end of it all, there will always be ignorant, inconsiderate morons who park wherever they please, whenever they please regardless of who they upset - in fact, I think they actually get a kick from seeing other people up in arms about it.

    It took me weeks of determined effort to succeed which I eventually did - you may think £20 is worth paying to avoid the pain. I was fighting on principle and would do so again.

    If you all think the thread is worn out then don't read it. The fact remains that profiteering companies are taking advantage. Please post when you receive a £30 fine for overstaying in a Car Park by say 10mins. The cost to the Car Park is 10mins of lost time NOT some arbitrary figure generated at no cost to them [but at huge profit] by some random company.

    We should be courteous drivers and park correctly and I'm sure most of us are/do. The level of 'ad hominem' replies in this thread is ridiculous. I can be almost certain the majority of us have parked illegally at some point. YES YOU ;)

    The debate is NOT about dis-courteous drivers but IS about the legality of what amounts to extortion by Private Parking Companies on Private Land. There is no Statute in Criminal Law for such penalties. Civil Penalties exist under Contract Law and as far as I'm aware no case has been tried in Civil Court [correct me if I'm wrong].

    Even the Town & City Parking website [specifically a news letter] details Parking Contravention Damages [Contract Law] as Fines [Criminal Law] .. read here [Page 2 under Redex Award for ASDA & TCP 2nd paragraph]. They CANNOT fine anybody! They may of course wish to take the case to the small claims court for damages.

    You can read here in the TCP Newsletter that Disabled Parking spaces are as yet NOT covered by Law. You may also note that TCP have won their 1st Local Authority contract. Traffic Management Act 2004 (as ammended) de-criminalises parking offences and allows civil action by Local Authorities and I suppose by their agents. So if TCP was acting as an agent for a Local Authority then this would be a tougher fight however they are not!

    The point of this reply is to inform people that PCN's (Parking Charge Notices) by PPC's (Private Parking Companies) on Private Land is simple extortion.

    Please DO NOT confuse PCN's served by Local Authorities with those served by PPC's. They are NOT the same thing although granted they look similar as it's simple deciet.

    Do your own research!

    The Op was from someone who admitted parkingin a bay designed for the disabled even though they were not disabled. There is no wonder therefore that the bulk of the replies were ad hominem.

    Disabled people everywhere get a fairly raw deal and someone coming here for ways of avoiding the penalty, whether legal or not, was bound to stir up emotions.

    The penalty may, or may not, be legally enforceable, but the person who gets slammed with a ticket when they use a bay which is there for others far worse off than themselves, ought to be ashamed of themselves, and in my opinion, the only way to get a point across to some people is to hit them in the pocket, where it hurts.

    As a point of interest, your comment (in red above) does NOT apply to me, and no, I am not disabled!

    A friend overstayed in a Private Car Park by 5 mins (cost in lost revenue 30p) yet a PCN for £40!? It's not proportionate.

    Local Councils/Authorities have all the powers necessary to regulate and enforce with appropriate checks, balances and discretionary powers but rest assured private ltd companies have one objective .. profit!

    Don't park in disbaled bays folks for sure but DO NOT pay ridiculous fee's to illegal Private Parking Companies either ;)

    Just my 2p worth but if you park in a disabled bay and manage to avoid the fine or invoice charge, you should donate the money saved to a charity for disabled people instead.

    The problem with this proposal is it would effectively bar a good proportion of disabled badge holders also.
