    I understand your fear on getting refunded, even if you do not, to take this appropriate action to get this crook remanded was necessary and would be some form of "consolation". Im sure most on here would agree, although a refund for all buyers and a long stretch inside for the scammer would be the icing on the cake, Im sure other cons wouldnt take too kindly to him for preying on mothers and fathers to be. We live in hope.

    Sorry havent read all the thread yet so this may already have been mentioned

    Hopefully paypal did hold all the sellers ebay payments for 21 days and those who left positive feedback did get their refunds before paypal released any funds

    For buyers who havent already filed your dispute/claim with paypal there appears to be a discepancy between ebay and paypals understanding of the new paypal buyer protection policy. Ebay seem to think the policy came into effect on the 7th October but paypal state in their user agreement the 30th September

    13. Disputes between Buyers and Sellers - Buyer Protection Programmes

    The following terms are effective for Claims filed on or after 30 September 2008. To view the protection terms and conditions for Claims filed prior to 30 September 2008 see Exhibit “A” to section 13 below.

    13.1 How am I protected if I have a problem with a purchase?

    PayPal has 2 programs to help protect you:

    PayPal Buyer Protection (for eligible items purchased with PayPal on eBay)

    PayPal Buyer Complaint Policy (for all other items purchased using PayPal on or off eBay).
    (together, referred to as “PayPal’s protection for buyers”).

    13.5 What are the eligibility requirements for PayPal Buyer Protection?

    You must meet all of these requirements to be eligible for a payment under PayPal Buyer Protection:

    Use PayPal to purchase an eligible item on eBay.

    Pay the full amount of the eligible item in one payment. Items purchased with multiple payments – like a deposit followed by a final payment – are not eligible.

    Send the payment to the seller through:

    The eBay “Pay Now” button or the eBay invoice, or

    The “Send Money” button of your PayPal account by selecting “eBay Item” and entering your eBay User ID and the eBay item number.

    Open a Dispute within 45 days of the date you sent the payment and follow the online dispute resolution process described below under “Dispute Resolution.”

    Keep your PayPal account in good standing.

    13.7 How much coverage do I get with PayPal Buyer Protection?

    If you see the eBay.co.uk buyer protection message and if PayPal determines a Claim in your favour, PayPal will reimburse you the full purchase price of the item and original shipping costs only

    PayPal Buyer Complaint Policy

    13.10 What is the PayPal Buyer Complaint Policy?

    The PayPal Buyer Complaint Policy is a process to help you resolve a problem with a seller through the PayPal Resolution Centre for purchases that are not eligible for PayPal Buyer Protection. It is similar to PayPal Buyer Protection in that it enables buyers to file a Dispute for an Item Not Received (INR) or for an item Significantly Not as Described (SNAD). However, recovery of any amounts is not guaranteed and is limited to the amounts that PayPal can recover from the seller’s Account, even if it finds in your favour.

    13.11 What is the process for the Buyer Compliant Policy

    Similar to PayPal Buyer Protection, you must file a Dispute in the PayPal Resolution Centre within 45 days of the date you sent the payment. Once you have done so, you should attempt to resolve the Dispute directly with the seller.



    13.12 What happens if I am unable to resolve the Dispute directly with the seller?

    You may escalate the Dispute to a Claim within 20 days of the date you filed the Dispute. PayPal will make a final decision for some – but not all – Claims. PayPal will generally make a final decision for an Item Not Received (INR) Claim, but will not make a final decision for a Significantly Not as Described (SNAD) Claim, or Claims involving Ineligible Items. This means that unless the seller voluntarily refunds your money, you will not recover any amounts for a SNAD Claim or a Claim for an Ineligible Item filed under the Buyer Complaint Policy.

    13.13 What if PayPal makes a final decision in my favour?

    If PayPal makes a final decision in your favour, we will collect any available funds in the seller’s PayPal balance at that time. However, recovery is not guaranteed and is limited only to the amounts that PayPal can recover from the seller’s Account. Any amounts collected from the seller will be placed in your Account

    For the buyers who filed a claim before the above date/s

    As far as I am aware if the paypal payments were not subject to a paypal hold and the seller managed to empty their account - the claim will depend on how much protection was shown on the listing.

  • New to this forum and big thanks to baby's mum for messaging us through ebay as we were also scammed to the tune of £65. We have contacted the police and will advise all of any further developments. Thank you again for pointing us in this direction and lets hope they get nailed.

    If I am not mistaken the 1st 5 people on the Ebay feedback list have already been messaged (just double checked and curly.lulu HAS done those)

    On a lighter note, I took my baby out in his new buggy for the first time yesterday, and he HATED it. He screamed the whole time. He prefers his big traditional pram.
