    I did not get a patronising lecture, they were quite apologetic! That does not mean I back the level of Barclaycard's late payment fees though, but there needs to be a charge levied on people who do pay late. Set up a direct debit for the minimum or full balance payment, it's not rocket science.
    I agree that there should be a charge but more of the level of aroung £2.50 that could in no circumstances be involved in the overdraft etc therefore it's implimentation would not cause additional charges down the line

  • i sent them 1 letter warning them id sue them... they replied then i replied and i recieved no other communication for 7 weeks. meanwhile i just sued them.
  • Mind you, it might be quite fun to face them in court, win, then drive off in my car which has the MSE bumper sticker ...

  • I received an email from LloydsTsb this morning saying they have waived the £10 fee for the DPA information and also the £5 charge for each copy statement. It also states the usual rubish that i agreed to their t&c when i opened the account but they are unhappy that i hve cause for complaint. The sent a letter as well which i received this morning also saying i will hear from them with in the next 2 weeks and again they are concerned i have raised a compliant with them - Yeah right!!!

    I actually downloaded 3 1/2 years worth of statement off their banking website yesterday and was quite supprised to see that this amount in itself adds up to £2300 with 8% added on top. The statements i have missing are the biggies when i remeber for a fact that some months they took £350 in charges and then it would carry over to an amount of approx £150 - £250 the following month. To anyone who is not sure whether to go for this or not when i was being charged left right and centre and struggling to get back on track the stress of opening another letter stating a bounced DD or cheque etc got to the point where i couldnt bring myself to open them for the stress it was giving me, i got to the point where i was scared of the postman coming, i used to live for Sundays and when Lloyds tsb offered me my first loan to sort out my overdarugft i accepted it feeling relieved, big mistake, one slippery slope. I am angry at what they put me though and at a time when i was very ill as well and was really struggling to keep the wolf from the door. This is my money and i want it back no matter how long it takes i will fight for it, if i owe them they send me solicitors letters or court summons and threaten the baliffes coming to my door. It's time the normal man/woman inthe street took control of OUR money back away from the banks and back into our hands.

    So in short: yes, they're bluffing. Don't let them intimidate you. Good luck. :)

    Yep.. Been through this 3 times with them today, quoting word for word. The response I got was something along the lines of "because we do not hold the information that can simply be printed off at the push of a button then we do not have to do this We have issued statements to you and if you want copies, pay for them"

    I then referred to the leaflet on how to access your personal information and it clearly states that any specific information regarding myself is my personal data and if you take that with the Durant V FSA then you can clearly come to the logical conclusion that I should be entitled to this information.

    To make me feel a whole lot better they then said that I was exploiting the system and it was wrong - felt like saying that banks as a whole exploit their customers and shaft them unreservedly but managed to keep my cool.

    Oh well, complaint issued to the ICO and will wait what comes back. When I get the response in my favour, I will have to give this person a call to ensure that they honour the 40 day period from when they received the first cheque!

  • A few weeks back i sent a letter to Halifax credit card for a refund on my sons charges, he received a letter back stating yes we will refund them only to date they have not been refuned onto his statement. So obviously i need to re write to them, so, do i threaten them with court action if they do not refund within 7 days adding on the 8% and court costs? or do i go down a different path? Haven't come accross this situation before or what to do in a case like this. If they threaten to close his account then he's not bothered, he has a stubstantial amount in a high interest account with them, they would lose out more than him as he is already looking to move this to get a better rate of interest, so that is not a problem.

    1 - Why is there a need to be a charge exactly? They levy an interest of approx 18% for all the time you owe them the money, therefore they are getting additional interest if you pay late. It follows that the charge is a penalty charge and THAT's illegal. That's not rocket science either, is it?

    2 - When the charge is not for paying late, but for going over your limit, usually because the interest they've added has taken you over that limit, how do you justify that?

    3 - When (as in our case) you have Payment Protection, but they refuse to pay out even though they took the payments for it, and you're in a situation of paying the credit card (which you shouldn't have to, you took insurance, remember?) or feeding the kids, which one do you choose?

    You have the right to your opinion. Please do not judge or patronise without knowing circumstances. And I hope for your sake you never have to be in the same humiliating position as some people here.

    Yep, I got the same standard letter, Helen. And like you I plan to take every step necessary to get back every penny ofmy money. It's mine. I worked for it. So why should they have it?

    I'll buy them a packet of envelopes and a pack of paper to reimburse their costs over the years - shouldn't be more than £3 from Tesco's Value range. Heck, I'll even chuck in a couple of quid for stamps. And an extra 50p for their ink and electricity to run the printer. But the rest is mine.

    I'm waiting for the statements now as the online banking only lets me go as far as July 2002, then I'll send another letter with the amount owed giving them a 7 day time frame to pay up in. Then as I'm whiling away the hours waiting their payment I'll draft my Court application and I'll be ready to push the button to submit it on day 8.
