Bank Charges - illegal?

    This mentions claiming back moneys for mortgage redemption penalty. Are we entitled to claim back these as well?

    Hi

    a friend of the family was round today at my parents house, she is a barrister, and a very good one at that, my dad was talking about taking someone to small claims court as they owe him money. We were talking about interest and she told me it was 8% OVER the banks interest rate! So depending on the interest rate of the bank if it was 18% you could charge 26% if it was 10% you could charge 18%

    Thought this may be of some help.

    Smile is easy.

    You enter a claim into Moneyclaim.gov.uk; they acknowledge the claim; then they pay up.

    Easiest yet.

    Interesting; I think that this may well be the case. But only if the interest was levied BECAUSE of the breach. i.e. All unauthorised OD's that were caused by the punitive charges in the first place.

    Could you ask her to verify that?

    This is just my opinion, and I would love to be proven wrong. (I often am ;-))

    Thought i would update you all,after i had logged my complaint yesterday recived a phone call today, asking if i would still like all the statements for years, i said yes please, and she said i will charge you 10.00 for them, so we have got the ball rolling. Can i add 8% interest and if so what wording do i put in the second letter to them?

    Actually yes - Bankfodder and I (from the 'other' forum) are starting the CAG (consumer action group) - basically, based on the fact that we get literally hundreds of emails (as a result of BCH and BAG - also, my PM box here - (any chance of a bigger PM box - 50 is nowhere near enough!!)) each day asking us about related subjects such as the aforementioned post - the subjects vary from mortgage redemption penalties to banks theft).

    So, we (and I am not legally qualified, although some of the moderators in the other forum as well as some of the admins are) have discussed the possibility of extending our 'remit' to cover things like this.

    That is not to say that we would be a contender for this site, on the contrary - this site is fantastic- we would only hope to help people who are in a position to take action against a company for misconduct - such as trying to get out of a warrenty agreement etc...

    Mind you, please bear in mind that I may have already spoken out of turn - we've just got back from France and so I have already 'sampled' the wine, beer (since about 1pm - I have no willpower) and cheaper fags (!!!!!! - I was on my fourth day of not smoking too), so I may be talking utter tripe.

    Thus is my disclaimer. ( I wonder if that would hold up in court?)
