Bank Charges - illegal?

I posted a letter through the banks door on sunday night and yesterday when in town popped in the bank to ask if it was being dealt with, the customer advisor rang a central branch and advised that i was to recive a phone call within 24 hrs to advise me of what was happening, and actual said to the person on the other end " to save any futher complaints" hense i have recived no phone call, so i have rang the bank central line and logged a complaint. I so am living in hope we get this money back, i am in the same baot as other people and the charges have pushed me futher over drawn and in a no win situcation. Please if any one can support me through this, ie a email buddy that has gone as far as taking tha bank to court in case this happens, (with my luck it will), as this is quite scarry stuff. I would think my charges are as high as 1,000. many thanks and please everyone keep your fingers crossed for me.0

I've today wrote to Barclays to request all charges be refunded.
I also wrote to Smile who are happy to supply the relevant information for the £10 charge.
Does anyone know if any of the Banks have won any case that has gone to Court?0 -
I've been struggling to keep within my overdraft limit due to excessive charges on my account over the last year, including interest the total amount is about £1000.
They always refuse point blank to refund me (though they say they have refunded about £50) and refer me to the t&c's. It's so hard to stay on track with all the charges, it's just a vicious circle.
Am I right that I could really go to a solicitor, they will take me seriously and I'll be able to sue the bank? Well if it is the case, I wasn't aware of this until going on this forum, so maybe they play on people's lack of knowledge of their legal rights. Or am i wrong, is it equally possible that I won't succeed? Pete.0 -
With regards Unfair Contract Terms. Can this be applied to high interest rates beng applied to a debt with the result of the debt never getting paid back because the interest is higher than monthly payments? I would appreciate it if anyone could point me in the right direction i.e. case law.0

Today was the day that Nationwide should have taken £400 from my account, which I don't have, in 'bank charges'. I wrote to them earlier this week asking them not to, and although I haven't heard anything from them, despite putting my phone numbers on the letter, no £400 has yet been taken out!Total debt May 2005 £83,232 :eek:

The Nationwide refunded my bank charges in full within a week of asking.0 -
To make me feel a whole lot better they then said that I was exploiting the system and it was wrong

Well I got my letter from Lloyds and was disappointed to see it was the same standard letter from David Just that everyone else seemed to be getting. Sent a reply back yesterday with a cheque for £10 for a complete breakdown of charges with dates, details and amounts as per the informartion commissioners freedom of info act 2000
and giving them the 40 days max, so will see what they say. I also asked him to carefully consider his next reply and not send a standard letter and do not patronise me. For those who don't know the letter basically says you agreed to the terms when you opened your account, we take charges, blah blah. He didnt even acknowledge the fact I had mentioned legal action at all. In my 2nd reply I made it very clear I would be taking action as that a standard letter was not doing them any favours, and that if it goes to court I will be adding 8% APR and their resistance will be noted and used against them which will be frowned upon by the court, so they should decide now if they wish to settle before going to court or accept the massive amount of publicity I will organise if it gets as far as court (I know it wont though). Im determined now to see this through to the end whatever happens though, and I want MY money back, which is another thing I made clear Im not asking for the bank's money it is and always was mines. I gave them 21 days originally, and now I told him the 'clock' is stopped until I receive the breakdown of charges where the clock will start again giving them 12 days before I raise the action. Quite excited by the prospect actually
Will keep you updated, and its great that we are showing banks we wont just be pushed around and that they can take crazy payments from people and in some cases, destroy people's lives.
