Abbey tried this with my partner (and you can't blame them for trying - I intend to do this every time someone I owe money too - and now there are few - starts playing around) - she refused of course (but only after some considerable coercing from me), and of course, got the full amount claimed for.

The banks know they are in the wrong.

    cool, ok then I'll refuse.

any ideas what I should say in the letter to help prompt them in giving me the full amount.

    thanks again.
  • Hi Guys

I watched the Sky news report on bank changes and feel i must act now. what if the report due at the end of March finds that the bank can charge but not at the rates we have seen £20+ will my claim be reduced accordingly. and in the worse case they agree the charges and i am at the stage of having paid the court fee which i can't afford to lose.

On a seperate note there are a number of letters to use when making a claim which one works best? i am thinking of using a combined letter one from the bankchargesinfo web site and one i have seen but can't remember where which started out "Due to the recent media coverage on bank charges" etc. the contents of this letter was nearly the same but was shorter and more to the point without quoting to many points

also mentioned was that the 8% interest claim can only be added when making the court application. not in the total amount being claimed 1st letter this is mentioned in the second letter to them where you state that if you go to court you will be claiming the 8% along with the court fee

    is this right.

The 'report' they mention is no such thing - the OFT had a meeting with Stephen Hone the other day and he told them that unless they came-good on their threat to the Credit Card companies, then the planned protest would go ahead. They said they would 'issue a statement to the press' by the end of March.

That's it. There is no legal ruling and this is only relevent to Credit Card late payments.

    Chinese whispers!

Go and have a look in the library section of the bankactiongroup web site - there's all sorts of letters in there.

    Hi Guys,

Well after just 2 letter Barclays have offered me, as a gesture of goodwill, £950 (50% of the claim).

So I accept it or carry on? If I carry on what should me next step be?

thanks for the great advice so far
What period of time did they take to come up with this offer?

I have letter one waiting to be responded to that I sent on 16 feb 06

    Cheers
