Bank Charges - illegal?

  • hi moneysavers, i have been reading these threads with great interest. i run a small buiness and cash flow is always a problem (well i'm the problem-rubbish with money-but i'm getting better with help from mse)

    Over the past 6 years i must have had hundreds of charges from the halifax-the thought of getting them back is great but as expressed by someone else i'm afraid they may close my account. I have poor credit and only use a halifax cardcash account -ie no cheque card or overdraft-I can do this because my name and business name are almost the same.
    I also noticed that they chaged me (£35)for not having the funds fo a standing order i have to a little known charity (£5-00 a month to the pulmonary hypertension !!!!!!.)-this was very anoying especialy as a cheque was clearing for a couple of grand the next day!(cheques take 6 days to clear -increase from 4 not so long ago)
    again -i'm afraid that my account would be closed -is it possible? I could always open another of this type of account with another bank first offcause-what do you think out there -should i go for it ?

    hi, just wanted to say that following the advice on here, i have posted the recommended letter to Lloyds TSB re illegal charges.

    i have often been charged for failed DD and cheque clearance etc but after reading MSE advice, began to calculate just how much.
    i only have statements back to july 2002, but charges since then come to £1080.98!!!

    when my son had major surgery and i had to leave my job, i informed Lloyds every step of the way, and let them know that my income would reduce.by then i had an overdraft of about £300.
    because of a problem cancelling AOL, I have had several returned DD and other charges added since then. whenever i did pay into the account the OD charges swallowed everything up.

    i finally got the bank to allow me to repay at £8 a month, as I no longer use the account.
    but the trouble I have had with this agreement, i wouldnt wish on anybody.
    so many different staff have called contradicting the agreement. and while paying £8 a month in to the account at their request, i have been consistently charged £16, so am always taking 1 step forward and 3 back!! :wall: :wall:
    they frequently demand larger payments just to meet the agreed OD limit again, then add another charge :mad:
    i have not missed a single payment and have visited my branch and phoned about every difficulty along the way...yet now have an OD of £800

    (sorry, had to get all that off my chest!)

    so...basically i am ecstatic that something can be done, i would never have dreamt of tackling them about unfair charges.

    will post when i get a reply ...watch this space.

    Wow - that was nearly a year ago.

    How time flies when your having fun getting all your money back ;-)

    What you sent me there was the catalyst that started it.

    That bank gave in so easily that I though I must be on to something. In my letter to them I said that I find it hard to believe that what they are doing is legal.

    I thought that must have touched a nerve, so I investigated it some more - and the rest is history, as they say.

    Hello can someone please point me in the direction of a letter to send my credit card company, they have slapped a 25.00 late fees on my bill, i have rang them, and they have refused to talk to me ref refunding the charges as soon as i mentioned that under the consumer act they could not enforce it, if i refused to pay. I need to send a letter please, see if they take notice of that.

    has any one had any luck with HSBC?? i worked out i am owed £1,416 back in charges. I have given 14 days notice if not i will start legal proceducing. This does fill me with fear, as i have never done any thing like this before, and not in the postion to loose the court fees.

    Hi Guys,

    Well after just 2 letter Barclays have offered me, as a gesture of goodwill, £950 (50% of the claim).

    So I accept it or carry on? If I carry on what should me next step be?
