    Yeah I thought of that after I put the phone down but, I ain't too bothered as I am pretty well set-up now as I have had my Halifax debit card and my autherised o/d plus I have a nice mastercard for months upon months with everything paid and all nice zero's (paid) on my credit report every month.

    According to my credit report the LTSB account isn't listed - don't know if that means anything!

    Given the above I might scrape through :rolleyes:

    We own our house as we had it left by a relative that died (years ago).

    I think people should stop having a go at dchurch24....his posts have been really helpful. I have always got my charges back as and when they occurred, as I am just naturally difficult about being overcharged but I know of others who are using the help and advice on this thread to fight the banks and are using advice given, extensively and free, by dchurch24.
    I don't know why people feel the need to "have a go"

    just to let you all know i was just on a article on the sky news report, regarding bank charges and i did plug the site for us all!!!

    There may be something on the website?

    If they start legal proceedings against him, if I were in his shoes, I would immediatly launch a counter-claim - and then sit back and laugh with glee!

    OK lets be serious for a moment here...

    1. LTSB choose not to report good account conduct. They also reserve the right to report bad account conduct - check your account T&C's.

    2. You may have a house now, but what if Mrs Fedz sees her dream home - and you can't provide it for her because you can't get a mortgage due to the default. What will you say? Could I place a deposit to hold it whilst I sue LTSB to get the 'default' removed from my credit report?

    3. What happens if you want a 3-piece suite from DFS, on their buy now pay later offer?

    4. What happens if one of you is off work for a while, and you need a loan to tide you over?

    5. What happens when Halifax 'routinely' search your file (as they entitled to do under your T&C's) and see the LTSB default?


    I'd advise you think long and hard about the course of action you are taking.

    Brief story so far:
    • Obtained 6 years worth of statements from HSBC - they moaned but I politely asked the Customer Service Advisor to check re: DPA with her manager - she did so and I got the whole lot for a tenner;
    • Went throught the statements and put all charges in an Excel spreadsheet to calc the 8% APR;
    • Wrote a letter addressed to 'The Customer Service Manager', asking for a refund of these charges - only a couple of paragraphs. Mentioned legal action etc;
    • Received reply stating charges were fair and that I should budget more carefully in future;
    • Wrote 2nd letter headed 'Final Notice Before Legal Action' - thanked manager for his time and copied/pasted the legal bit from my first letter, giving 7 days;
    • Received 2nd reply, stating charges fair and were as published;
    • Sued using Moneyclaim Online; used the text provided at Bankchargeshell - bit hard to squeeze everything in the boxes they give you but it was otherwise really easy to do;
    • HSBC Acknowledged my claim with the court very quickly;
    • Received letter from HSBC Solicitors stating charges fair, as published, would stand up in court etc. They are mindful of management time and so have agreed to cough the money in full (including court costs and 8% APR) - does this mean they'll settle any claim of any type so that their managers don't have to look at it?;
    • Wrote letter today stating will accept their offer but won't accept the "reasonable" gagging clause they've inserted; my letter asks for a revised offer of payment.

    Will let you know how I get on. And have started looking through all my other accounts...
