Hi all,
Im hoping for a little advice....
I today have had card through the post basically saying to contact MH urgetly by 12th July.
I dont know what this is for, however, I do know that I have a few unpaid debts from my parents address that I havent lived at for over 6 years...
I have moved since then a few times and have owned my own property for the last thee years and can get credit no problem as I dont mention the address where the debt was owed (As they only ask for the last three years addresses which I have an excellent credit history for)
Basically, do I ring them and say that it is not me and you have got the wrong person, but I am worried that the bad credit will get put on my file for my new address? Can this happen as the are not sure it is the same person???
Help, I am worried as I know I was stupid to leave this but I was young and daft (over 6 years ago) and havent ever had a debt letter sent to any of the adressses I have lived at since, I have worked hard since then to get on the right track and got a good job and have a really good credit history at my new address but dont have any cash spare as have a mortgage and kids but dont want people knocking at the door or anything.
Any advice would be great????0 -
:Tyour situation was very much like mine, I too ran up lots of debts at my dads house then he sold it and moved on. Since then I have lived at a few different adresses and haven't heard a peak from any of them since yesterday. Mine to was over 6 years ago. I haven't even tried to apply for any store cards, credit cards etc..... I just assume that my name is mud, black listed. I didn't realise that it worked on addresses. So have you contacted them yet? What I did yesterday when I got the letter was ring them up and confirm it's you, then they'll tell you what the debt is in relevence too, when they tell you this you must say to them I would like you to send me a copy of the orignal contract which I signed, they'll say they'll send it to you but I think and hope they are bluffing. Just read above posts Walshy Walsh asked them for this and they never sent it and he hasn't heard from them since. Hope that helped.0

Hi loubylou
This probably is one of your old debts. But that said it sounds like it is probably statute barred. If its over 6years old it would have dropped off your credit file by now anyway, so you shouldn't need to worry about ruining your rating.
You shouldn't even need to get as far as asking for your agreement, first they need to prove that you ever owed this money, they need to give you details of the alleged amount owed and the original creditor. If they do this then you can assess whether you think its statute barred. If you do then you can send the SB letter template. Just so you know they are allowed to chase you for a SB debt until you inform them in writing that you know it is SB and don't intend to pay.
However, if this is just a card and gives no details of the debt etc I would ignore it and they will probably send a letter in the post giving you more information. I wouldn't call them.
When/if you get such a letter you would send the prove it letter and then when the prove it send the SB letter.

Hi, Thanks for the help...
I haven't called them, I dont want to get into a coversation about it.
With regards to the six year rule, for credit rating and SB, when does the six year begin, the first time you missed a payment???When does it drop off your file six years after missing a payment or can it keep going back on your file every time MH go on there??/
Im worried that they will now be able to log this bad debt at my new address starting a fresh thats why Im thinking of calling them and saying no such person has lived at this address. I have been very careful not to have any links to the address I had these debts...
Shall I just wait to see if I hear anything else???
All experience and advice is welcome0 -
as far as i know, it is from when you last paid, although it could be from date of default. if you make a payment or admit "IN WRITING" within this 6 years, the clock starts ticking again. but once the 6 years have passed and the dwebt becomes statute barred it can never go back.
i suppose after the 6 years you could actually write and tell them that you did owe the money but have no intention of ever paying, and by law there is !!!!!! all they can do.0 -
LoubyLou You can be sure that if you don't get in contact with them then they will not leave you alone. To be honest the template letters are an excellent help, I would print one off (obviously after changing a few details relevent to you), and then send it. Or just call them and ask for the a copy of the original contract you signed. There are ways about this. It'll be fine. Yours was over 6 years ago and falls into a certain sector, mine is about 5 years old, so I need to play this carefully.0

Pouncer, have you heard anymore form them???
Has anyone ever had anything back after sending one of the letters?0 -
Hi Louby
Haven't heard anything from them yet. Fingers crossed I won't. But usually they are pretty quick off the mark, so i'm just assuming they don't have my contract!!0 -
Hi I recieved letters from MH and phone calls I also recieved a txt saying i had been approved for a loan which happened to be for the amount MH said i owes them. i have been threatened with debt collectors etc but when i asked for proof of the debt they did not answer my letters i will now try the letter above, MH just seem to be chancers.
