  • My aim is to have at least £10 left 24 hours before payday! As bad as it sounds it has rarely happened in the last 2 years.

are you sure ,the letter looks and sounds nasty , i dont want anyone turning up at my door

Won't happen - MH don't have field agents.

If they can't specify what it's about, or who you supposedly owe money to, and for what, it can't be that important.

Last week I had a letter addressed in my maiden name, on opening it it was a letter from Mackenzie Hall telling me I had a debt to pay and that I must contact them immediately, if I am not the person then I must contact them also - however on the envelope it states only to be opened by addresse!
Anyway I ignored it, ordered a copy of my credit file which I know is squeaky clean and yep it shows no debts outstanding.
I had a CCJ in 1997 and after 6 years this has now been removed from my account.
However today I have another letter from them saying I owe £75.00 to shop direct finance - littlewoods Index extra and it states at the top FAILURE TO RESPOND - NOTICE - they have given me until 4th Feb 2011 noon to pay the amount and that they will take further action if I don't respond.

Am I right in thinking that due to it being over 6 years they have no cause for redress and if it is not showing on my credit file there is nothing they can do. I have been married for 6 years.

I have today used the template letter on one of the first pages and emailed it and posted it to them.

Am I right in thinking this is another scummy debt collection agency that has bought debt over 6 years old where the companies have no cause for redress and they are going to attempt to scare clients into paying up.

    Many Thanks

    Kelly

    Hi Kelly

Was the CCJ you had in 97 for this debt? or something else?

Assuming this isn't the debt with a CCJ - when you say its over 6years old - do you mean more than 6years since you paid anything to littlewoods/shop direct? It is possible a debt can be gone from a credit report but still not statute barred (if you paid anything to the account after a default was added).

If you think its statute barred (no payments for 6years, no written acknowledgement from you that you owe the money for 6years and no CCJ) then you should send the statute barred template letter.

    I second that.

    Hi,

Honestly I can not remember 100% what my ccj was for!! It was in 1996 i think, i know it was for less than £100 so could of been this.
Either way I know I defintely have not made any attempt or contact with the company to pay the amount.
Do i send the letter on page one or the letter on this website

If it was the debt with a CCJ then it won't be statute barred. They could still write to your for payment etc although they would have to go back to court to be able to commence any of the methods for collecting a CCJ (eg instructing bailiffs etc).

I would use the national debtline template letter.

Doesn't really matter which name you sign in, you could use your maiden name. Though they can probably find out your new name from the credit reference agency anyway.

But if the CCJ was satisfied, had a letter to confirm it surely they would not be able to redress, also it has been over 13 years and it has completely been wiped off my credit file now?
