Old Debt? Mackenzie Hall

If the CCJ was for this debt and you paid it off then you wouldn't owe them any money. So it wouldn't be a SB debt instead you would have to dispute that the debt existed.
When you get a CCJ you get a copy of the judgement and when you settle the CCJ you get proof from the creditor and send it to court so it can be marked as satisfied. So if this money they are trying to claim related to that then you should be able to prove that the debt does not exist.
I think that that situation is fairly unlikely. Its much more likely they are chasing a SB debt that has never had a CCJ - its what MH are known for.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
that's what must of happened then as I have a stamped document from the courts saying it is satisfied June 19970

I have just started receiving missed calls from MH - one per week. I know that if I have any debt that it is well over 6 years old (more like 8) and that any CCJ would be of a similar age. I have just done a credit search on myself to check for CCJs or for default info but will have to wait a few days to get that info back.
I went to the CAB after the first call and they gave me a copy of the "Without Prejudice" letter to send any debtors that get in touch and that even if I have a CCJ that it will also be SB after more than 6 years...IS THIS TRUE?! I keep reading different advice on this and don't know what to do.
My husband tells me that I just need to sit tight, refuse to talk to them on the phone and request contact in writing but I am terrified and this is causing me so much stress. I am physically shaking as I am writing this. Any advice?0 -
Hi
A debt with a CCJ cannot be statute barred ever - but if its been more than 6years since they obtained the CCJ then they have to go back to court to get permission to continue chasing the CCJ.
have MH not written to you at all yet? If not then as hard as it is the best advice is to ignore them - or if they do catch you in to just tell them to write to you and hang up.
They thrive on bullying people and making them feel stressed -try not to let them win. Sounds like you are unlikely to need to pay them any money (MH rarely have debts with CCJs to chase, far more likely that these are SB debts or not your debts at all).
Whatever you do do not agree to pay them any money on the phone and do not give them any bank details etc.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Will do - I am surprised that they haven't just written straight away instead of phoning. I am just worried that a) this will go on indefinitely and b) we will get debt collectors coming to the house. It's really scary and I wish I hadn't made such bad decisions all that time ago. I will know how to deal with it better when I know the situation with CCJs against my name I suppose.0

I'm not! They do not like to put their [STRIKE]lies [/STRIKE]statements in writing in case you report them. Most people don't record phone callsToffeeApple123 wrote: »I am just worried that a) this will go on indefinitely and b) we will get debt collectors coming to the house. It's very unlikely that you have any ccjs without your knowledge.
Also MH do not do home visits.0 -
Mackenzie Hall has contacted me requesting the payment of an alleged debt without documentary evidence. When requested it they closed my account and sent it back to the creditor (Cabot financial) in view to receive the necessary documentary evidence. In the end the creditor apologized telling me that I was not theu costumer. I got very !!!!ed off with Mackenzie Hall because they tried, threatening legal action, to take money from me without having any documentary evidence whatsoever since the beginnig. For this reason I am asking them compensation for breach of the Consumer Credit Act 1974 and gratuitous harassement but ther simply state that there were no necessity for them to be in possession of any documentary evidence prior to contacting me.
This is for me an unbelievable approach. What do you think it is lawful? Hoping to receive any good information from any of you, thank you for your help0 -

Hi Fred
Ask for their 'final response' on the matter. They have eight weeks from when the complaint was first made.
You can then refer it to the Financial Ombudsman Service. The complaint form is very straightforward and on the FOS site. Although it will take them a long time to adjudicate, they may well rule in your favour. You may also wish to send the same information to the Office of Fair Trading. Although OFT do not respond to individual complaints, they will add your evidence to their dossier on Mac Hall.
Should think they'll need a forklift to move that...0 -

The debt would be statute barred. The fact that you admitted who you were over the phone doesn't change that one bit.
Send them the letter in this link.
