With regards to pass the parcel, it doesn't matter, you bought the vehicle from Thurlbys and the contract is with them, it is up to them to seek recompense from their supplier. Do not be piggy in the middle, it is not your concern about the wranglings going on about who will foot the bill, Thurlbys should get the work done and sort it out afterwards.
If Vx didn't approve the mods then their standard warranty will be void, particularly in this case as the mods will have a direct effect on the gearbox.
However, if Thurlbys led you to believe that the warranty was still valid, either knowingly or unwittingly, then they are liable. I would say that the burden of proof would be on them to prove to a court that they explained to you that the manufacturer's warranty wouldn't cover the car. The fact that they've given the warranty book and it has been serviced should be more than enough to prove your case.
Personally I'd pick up the phone and call Vx and when you get through to customer service, ask them or try to get put through to
tech service/warranty dept. and ask them whether these special editions were covered by the manufacturer's warranty.0 -

Thanks Roadhog, OH is basically leaving them to sort it but making sure they know he isn't happy at being without a car. I know that Thurlby (or rather the guy we know personally at thurlby) is dealing with it but also ignoring OH's calls. It will be sorted and OH won't pay a penny for it whether the try to make him or not, he won't pay as it is under warranty. We believe the bill could be around the £2k mark

the logical answer would be to check your paperwork from where you bought thcar,read over it and then take it back to where you bought it from.
if you bought a toaster from argos that was made by tefal and a resistor in it was made by seimens failed,where would you take it back for repair/replacement?...work permit granted!0 -
Update:
OH has been in touch with Thurlby today. Gearbox is on order, possibly friday it will arrive. It is being done under warranty however at Thurlbys cost. They will not give a courtesy car though which means OH is screwed for work at the moment unless we can sort something out.
Good news that it is being done though.
