Driven to despair! Where do we stand?

Hi all I am looking for some information on where we stand with a problem.
22 months ago OH bought a limited edition car from a franchised dealership and now 35,000 miles later the gearbox has packed in. The car was modified by the manufacturers performance team before released for sale. Please note OH is the first owner, this is a brand new car (or was at time of purchase)
A fault developed 3 weeks ago with the gears it was returned to a local dealership who commenced work under warranty, authorised by the manufacturer. The car was returned almost 2 weeks later on the Friday repair incomplete as the gearbox has a known fault and is under investigation by the manufacturer. Manufacturer says it is known about but claims it is safe to be driven.
After a family day at the Zoo on the sunday, heading home the gearbox gave up the ghost, out of 6 gears he was left with 2.
Monday am once the dealership was open the car was promptly returned for me to be told 3 hours later the car would not be repaired under warranty.
I contacted the dealer that I purchased the car from who has since picked up the vehicle and relocated it to their workshops over 200 miles away. The garage is now dragging their heels over the repair, no work has commenced I have not been offered any courtesy car so OH is inconvenienced without transport.
What can we do to Gee them up or get a courtesy car? Where do we stand legally with a car that is not fit for purpose?

You should be covered by the Sale Of Goods Act.
22 months? So it should be covered under a 3 year warranty - if one applies.
As it's a known fault, go to the manufacturer rather than the Dealership.
Go armed with info from google etc...

sometimes its 3 years or 35,000 miles, whatever happens first.
If this is a bit of a limited car, have you tried to contact other owners? Maybe they have had similar problems? A friend of ours had a similar issue with a clutch on diesel PT Cruisers failing at just after 35000 miles, they demonstrated to the dealer that it was a common problem and Chrysler did fix it under warranty.

Most warranties are 60,000 miles. Lots are more. i'm yet to hear of one at 35,000 ish.
anyway, as pointed out above - why not see if there is an owners club. Or tell us what car it is and we may be able to help...0 -

Lol, seems Chrysler has changed to 3 years or 60,000 now. Typical.. that said its never let us down anyway.0 -

its 3 years warranty or 60,000 miles, it is a known fault with the manufacturer. We know plenty of other owners who have the same style car which is also a limited edition, and also the other owners who have this limited edition of the limited edition if that makes sense.harveybobbles wrote: »Most warranties are 60,000 miles. There is an owners club which OH is a member of and Junior Admin of, he actually designed the website
Would rather not say what car it is as at the moment it is irrelavent. The car has failed and unusable getting this sorted is a priority.harveybobbles wrote: »Probably yet another CVT audi box...

Thanks for all of the replies. At the moment OH has emailed the dealer where the car is, and also has contact details for the man who is the man to be within the manufacturer and knows him through car shows etc. Tomorrows plan of action includes trying to get some sense out of someone and also involving this man.Raising kids is like being held hostage by midget terrorists0
