ahhh so its happened to others. In which case I would think you could prove a common theme. The threat of Watchdog is a good one, point out how much watchdog love cars with faults (remember the clio!?).

Not giving the car makes it a bit trickier. But just a thought you wouldn't expect an F1 car to do 35k miles on one gearbox and if yours is all souped up then the similar peinciple might apply?
Just a thought.
But if it was me I would be gathering evidence and hounding the dealer (seller) and manufacturer.0 -
BTW, what reason did they give that it wouldnt be repaired under warranty?0

Because it had been modified with increased torque despite the fact this modification had taken place at their own performance centre before being released for sale.Raising kids is like being held hostage by midget terrorists0 -

All circumstances are different, if you want advice here, you're going to have to name the vehicle so that we know what we're dealing with.
Naming the car won't affect your rights, so either tell us what it is so that we can advise you or go through the courts to get satisfaction.0 -

This is a sale of goods act query and I was advised to post in this part of the forum. The make and model of the vehicle make no difference at all.Raising kids is like being held hostage by midget terrorists0 -
I would be contacting trading standards and Watchdog, maybe the local paper or even a national one would be good. Contact Top Gear, Fifth Gear and other car problems.
The car has a known fault and should therefore be repaired under warranty.
It shouldnt matter how long you have had a vehicle if there has been a recall it should be repaired FOC - there was a recall on my Toyota Yaris but the dealership for some unknown reason failed to carry out the modiification on any of the services but when my car developed a different fault out of warranty it was then that they noticed that the brake modification hadn't been done at that time my car was 5 years old. Needless to say I had the repair done and now use a different garage for my services.0 -

As an ex-area manager for a car manufacturer I shan't be answering any questions and I think you'll find a number of other qualified members probably won't reply either.
If it is purely a matter of SOGA, then file a claim at the County Court if it is that cut & dried. However your questions lead me to believe that there is a bit more than we're being told.0 -
There is nothing more than I have stated above. There however is no need to put the make and model of the vehicle. The gearbox has a known fault yet the manufacturer is refusing to replace it as even the new boxes have the same fault. Its that simple. I appreciate everyones help however I am not wanting to give the make and model.Raising kids is like being held hostage by midget terrorists0

If it is purely a matter of SOGA, then file a claim at the County Court if it is that cut & dried. However your questions lead me to believe that there is a bit more than we're being told.
i would have thought seen as the op is asking for help from folk on here it would be nice to let us know what car this is,so future advise can be given and to help out other who come to the forum with the same fault.
obviously the help is only one sided....work permit granted!0
