Kaz, I remember a case recently where a family had to repay housing benefit because when she passed away she haddn't declared everything correctly but no idea when it comes to care home fees. It might be worth getting advice from another solicitor if it is a large sum or asking the solicitor concerned what the legal standing is, surely he'll be able to provide legal evidence for this.
So far just found http://www.direct.gov.uk/en/HealthAndWellBeing/HealthServices/CareHomes/DG_10031523 which doesn't explain much, so it may have been done on defered payments in which case yes it looks like they would be entitled to reclaim any fees. I am sure you could ask to see a copy of the deferred payments agreement.Deferred payments agreements
Local councils can make deferred payments agreements with people who are assessed as having to pay the full cost of their care home fees because their homes are counted as capital. The aim is to allow home owners to avoid selling their homes to pay for the cost of their care.
Under a deferred payments agreement, you pay only the contribution you would have to make if your home was not counted as capital, while the local council keeps a record of the remaining amount that you owe. At the end of your life or at an earlier date of your choice, the council collects the money it is owed either from the proceeds of the sale of the house or from whoever inherits the property.Individual agreements should be put in writing and should state categorically that the resident or their estate will repay the full amount of the deferred contributions following the end of the exempt period. This should then be signed by an authorised officer of the council and the resident, the holder of Enduring Power of Attorney or a receiver appointed by order of the Court of Protection in the case of residents who lack capacity to act on their own behalf.
So you should ask for a copy of the agreement IMOOne day I might be more organised...........

All i've got left to do today is football run and maths run then I'm done. DD has asked to go to a math's is fun class once a week with a tutor. It's made her much more confident so i'm guessing it'll do her no harm apart from the dent in my pocket!!

kazwookie There should be some paperwork that shows some sort of agreement if that is the case so if you can see that it would help. But agree with everyone else; get more legal opinions. Do you have legal cover on your house insurance? There is often a free helpline but you definately need to see the paperwork.I love deadlines. I like the whooshing sound they make as they fly by. After a calm conversation ( I was seething internally) she explained that.... her friend (age 11 was) with her older sister and older sister's friends, and that they (older girls) don't get the bus early, i.e. the first bus that comes because.... ready ladies.... because they're not "boffins or geeks"
My DD1 was scared to come on the bus by herself, so was waiting with her friend. I explained that she should have left them, and got on the bus when it came. I said, what if it was raining, would they still wait unboffin like getting wet? I also said that perhaps they're not trusted with the house key, and so prefer to wait at the bus stop together, rather than go home to have to wait for someone to get home and let them in?
What stupid little cows, 'we don't get the bus straightaway because we're not boffins'!!!! :mad: :mad: :mad: :mad:

I am slightly ashamed to admit that I am still only two thirds of the way through sorting the childrens toys in the LR despite spending mot of yesterday on it and part of today! Shocking just how much junk they have. Father Christmas is going to be a lot more frugal this year.
I have a couple of hours to myself every afternoon this week as DS2 is at school for the afternoons. I plan to attack one room a day in this time. Good intentions at least.

Vacuum under furniture you can manage to move without hurting yourself
