In this situation I would send the "Prove it" letter. Always remember the onus is on THEM to prove it not you to prove you dont have the debt. The template can be found somewhere on this forum - I'll have a quick look since I have used the letter myself.

have now lodge a complaint with the fos -
on tues liverpool b card gave me atelephone no to ring
spent from 5 past one today until 2 min to three they cut me off - trying to ring number at barclays spoke with atleast 7 named people in india callcentre who say they cant find me on the system with the reference number i was given to quote so why have i had a ccj and allocation papers?
fealing v low - local cab appointment thurs 29 jan hope thy will be able to help fill in form allocation questionnaire it has to be returned to court by 02/02/2009. i have been trying to resolve this since begining of July last year!!

You shouldnt sign because it has been known, alledgedly, that some DCA's have lifted the signature for their own use.0 -
Well after sending the prove it letter as suggested by bazza, I've now received another letter(as well as a phone call, They asked for my date of birth and i said no...and that was pretty much that) Basically saying:
That i've raised a query and they'll be in touch with their client to advise them of my comments, and that this may take up to a month and then they'll be in a touch again.
Guess i just have to wait it out, Thanks for the help, no doubt i'll be back for more help when they get back to me.

i took the q.a. to courts friday cab helped fill it in court said i would have to wait around 6 weeks to hear from them........
b.c liverpool rang twice last week said my formal complaint was closed..yet letter said they are investigating and will let me know?
they told me to ring xxx number to resolve just under two hour and i got cut off spoke with 7 people in india the ref number i have does not register on there system am i sure that i have a account with them....to write to head office. The reference number was given to me by head office!!!!!
have forwarded it on to f.o.s. for there offical complaint. ref number obtained.. so much paperwork from not on duty names departments- if only a senior manager would take responsibility for my case it would be sorted i am sure within a day or less...grr0 -

Hi everyone! Well after sending numerous letters asking for all communication to be in writing only I received the usual solicitor letter. Ra ra ra Final charging order ra ra ra. Anyway so being stronger now than a year ago when this all started I rang them. After listening to some rubbish tune and all our operators are currently "helping" (bullying it should say) other clients for 6 minutes on a 0870 number I finally get through to someone. So I am in debt and they are milking the money from phone calls! Anyway I began the conversation with the fact I had been waiting 6 minutes and could not afford to talk for long. I was on the phone long enough to inform the boy that I was on a 95% mortgage, 5% unsecure, interest only and neg eq. All he could say was well there is nothing else that can be done at this time then! Yeah sending me threats about charging orders means nothing when I don't actually own ONE brick of my house! Also informed him I would not be ringing again and letters only from now on! Wonder whats to come next!JULES
