AFX - sounds like a fishing letter that they may have sent out to everyone with the same or similar name you yourself. You have two options. Either ignore for the time being or send the 'prove it' letter that is on the national debtline website.

Personally i would go with ontion 1 at the moment

Hi again, well just received another letter from them, this time stating:

    LEGAL PROCEEDINGS

    I regret that the above sum remains unpaid, we now intend to take legal proceedings against you, If successful it may result in;

    blah blah numerous threats

    ----

Now i still have absolutely no idea about this £474 debt and it certainly has nothing to do with me, So any idea on what my next step should be? I'm starting to get a bit annoyed about it all now. I really want to get this sorted, but why on earth should i have to ring them?

    Thanks again for any help

I received the usual stuff from 1st credit in reponse to asking to communicate in writing only. All the stuff they can do - Attachment of earnings etc etc. PLEASE TAKE THIS FINAL OPPORTUNITY TO MAKE CONTACT. Whatever. Anyway I have printed off the CCA request form, who do I make the postal order payable to? How much would the postal order and recorded delivery cost as I am very short of money at the moment but don't want to leave it til payday which is 30th. Thanks.

If you are 100% sure that the debt isn't yours, then if I were you I would just leave it and let them take it to court. Once there when you prove that you are not the one who they are chasing, they will get severely reprimanded by the judge and then you can claim for costs against them.

If you ring them like they want you to, they will probably call you a liar over the phone when you deny owing the debt and threaten you with bankrupty. This is what they always do. They never play by the rules.

If you are sure you are in the clear, I'd do them for compensation and teach them a lesson.

Thanks for the reply Cocker, I am 100% sure i'm in the clear, they claim this debt is from someone called casheuronet uk, Who seem to trade as quickquid over here and i've certainly had no dealings with them.

Despite this though it's still a bit worrying, I think it's disgusting that they can even threaten me like this over a debt i have no knowledge of. Doesn't say much for our financial regulators that they seem to be able to get away with doing things like this to so many people.

Thanks again, and any other peoples advice would be gratefully received. Although i am leaning towards going with your advice at the mo.

    These letters are computer generated.

IF successful, well they are not going to be successful are they??? So the threats are meaning less.

Postal Order £1 crossed and payable to 1st Credit, recorded delivery will be £1.30. You can check the delivery on tinterweb by using the reference number on the PO receipt.

Yes definitely worth getting it signed for, also don't sign your name on any communication.

Just 1st Credit and not 1st Credit Limited? When sending monthly payments via postal order I assume I cross it and send it with that name too. Sorry I know I sound stupid but want to make sure they receive their monthly payment as they will not provide me with bank details because I refuse to phone an 0870 number or text and give them my mobile so they are able to ring constantly.

They have so many entities, 1st credit will do jules.
Good Luck with them, they are obstinate gits at first, but they usually calm down.

Just to join on this (I posted similar to another thread).

I got a letter from BarclayCard saying they have assigned my debt to 1st Credit as of 1/7/2005!!!! (yes 2005!!!) A couple of days later I get one from 1st Crud introducing themselves and cough up. Amazingly the 2 letter arrived in the same style envelope and the exact same return address. Do they think I am stupid?

My question is do I send a "Prove it" letter or a CCA request?

    Thanks in advance.
