Keep this one for future reference,
'Subject to the Money Laundering Regulations 2003 ( see Section 6 (1) Record-Keeping Procedures) failure to keep accurate records and copies of said documents is a breach of this Act.
Furthermore, your continuance to enforce a debt you know and have been made aware is unenforceable can be construed as Fraud, by virtue of Section 2.
Fraud by false representation and by the definitions given in Section 5 of 'Gain' and 'Loss' in the Fraud Act, enforcing an unenforceable debt is misrepesentation on your part and a clear breach of this Act.'

Hi Everyone
I am joining the "owing money to 1st Credit" thread! Hope thats ok. I am assuming it is the same company. I have not heard from them yet but received a letter from Barclay card this morning saying they had assigned the debt to 1st Credit (Finance) Limited on 1/12/08. After reading all the posts (16 pages) I am very scared if I will be able to handle this. Although Sky card never had my home or mobile number so hopefully 1st credit will not ring but then will someone come to my house? The debt is for just short of £4k. I have a DMP with CCCS but only for token payments at the moment because I am on SMP until February. Should I just wait for them to contact me? Should I ring CCCS? Only a few days til Xmas and can't be bothered with this! I already have had CCJ paperwork through for another debt from Santander but feel better about that than this! Doesn't make sense!JULES

Hi guys, sorry if this has been covered in the thread already, i have had quite a trawl through but it is quite hard to work exactly what would be relevant to my case, Namely that i received a letter from 1st credit today stating that they have taken over a debt for £474 from a company called casheuronet uk, who apparently trade under the name quickquid(some kind of payday advance company), I've personally never heard of either company and certainly dont have a debt with them.
All the letter really states thus far is that they want me to call them to discuss "payment terms". I was tempted to simply ignore it, but i figured it was prudent to perhaps get some decent advice first, So any ideas?

AFX - sounds like a fishing letter that they may have sent out to everyone with the same or similar name you yourself. You have two options. Either ignore for the time being or send the 'prove it' letter that is on the national debtline website.

Wait, Jules. Then the first thing to do is INSIST on all communication in writing.....they will refuse, but they MUST do this if you request it.. NEVER sign any communication, e-mails are good cosofauto reponse. They do get nasty, thats their way.....so make sure that your caller I D is updated with their name.
They WILL say Charging Order, Statutory Demand, Bankrupt etc..they always do.
You say.' i have a dmp with CCCS, allcommunication should go through them, I am doing all I can to repay my debts ' thats all, no offers and no borrowing to pay them ( the phone staff are paid commission, so they push hard...thats why you dont talk onthe phone.

Didn't ring them but told CCCS and they have been sent details of my DMP which they will not like as it is token payments til March when I return to work. I changed my number recently so they shouldn't be able to phone.JULES

1st Credit are one of mine as well for a large unsecured Northern Rock loan - balance currenty over £12,000. Over the past 3 years I have had lots of letters, statutory demand, solicitors letters etc, but they have taken it any further. They are quick to send out default letters if your payments don't hit the account on time, but I managed to get a named person to deal with (with a direct phone number) so I can contact her and let her know of any problems meeting payments and I have to say she has been very good with me but do agree that the letters do come across as a bit intimidating and scary0

From what i have read they do not accept DMP payments. They have refused to agree to mine anyway. But they can not refuse to post them onto the account so i just keep paying through the CCCS.0 -
I got a letter today asking me to call them to discuss the offer and make administrative arrangements. It says at the end "If you do not contact this office we will assume that you no longer wish to make an arrangment to clear the debt". I am going send a letter recorded delivery asking them to deal with me through letters only. My problem is I am on a pro-rata payment plan and I need details of where to send the money.JULES
