    Good idea. Tell them that you are on dmp with CCCS 'i am dealing with my debts in a responsible manner and doing all I can to repay them via a dmp with CCCS'

    When i originally spoke to the CCCS they couldn't do anything until i had a reference number from 1st credit. When i phoned 1st Credit they wouldn't give it to me. I was going round in circle. I asked for all communication to be in writing and the fortunately the letter had my reference number on it.

    Hi all,

    Well, after a couple of letters in either direction, 1st Credit have now replied to me with the following letter.

    Dear Cocker100,

    Thank you for your letter dated ******** of which contents are noted.

    In your letter you have raised several points, I will address these individually.

    1. I refer you to point 1 of our letter dated ******** that we have requested the original agreement from Goldfish, and will write further once said documentation is received.

    2. We do not believe we have placed you under any duress and if you have been misinformed by ********(DMP company) this is an issue for you to take up with them. We accepted your offer based on you making additional payments, 1st Credit Limited are in no way obliged to accept instalment plans to repay a debt and are entitled to request payment in full.

    3. We are aware of the correct application via the courts for an application for a Charging Order, a process we and many other creditors use as a last resort when a mutual agreement cannot be reached.

    4. Please supply us details of the OFT rules you allege we have broken.

    5. We do not threaten legal proceedings, as a responsible and professional organisation we inform all customers of all possible outcomes if a debt is not repaid. It is not 1st Credit policy to harass debtors, letters and phone calls have the objective to advise debtors what payment is due and/or possible consequences of non-payment and thus will not breach s40 Administration of Justice Act.

    6. I refer you to our letter dated ******** where we state that we may consider bankruptcy proceedings; we do not consider this as threatening.

    7. At your current rate of repayment via your debt management company it will take over 20 years to repay the above debt, we do not feel this is acceptable and invite you to contact this office with a mutually acceptable offer of repayment.

    We look forward to hearing from you within 14 days from the date of this letter failing which we shall have no alternative than to instruct our solicitors to consider appropriate action.

    Nearly wet myself reading all their bull. Not threatening!!! Yeah right!!!


    They still haven't even sent me a TRUE COPY of the CCA, only an edited photocopy about 3 month ago. Do they actually think that any court would rule in their favour??????


    Any ideas of what to reply with.

    Cocker, was that from the lovely Audrey Shim Quee?
    If so, she seems convinced that her staff are the most perfect people inthe world, always abiding by OFT rules and never, ever threatening.
    I have suggested to her that she listens in to some of their phone conversations......especially the initial ones with new 'clients'.
    Give this lot enough rope, keep complaining about them and hopefully they'll eventually hang themselves.

    3 months is up later in the month on the lack of my CCA, so payments will be stopped....and then complaints to FOS and possibly report for Fraud as well!

    I forgot to mention above, this letter was signed by Mike Harker, Compliance Officer. All others have been her, but not this.:confused:

    Maybe even she has had enough of this bunch of freaks!!!:rotfl: :rotfl:

    My CCA request was sent in September. Thet sent back a badly photocopied EDITED version of the application form, so I complained. Still waiting for true copy!!!!!

    I'm into my 4 month now and still no CCA. CCCS have advised that i do not stop payments though.

    WOW!!! I cant believe that even 1st Credit could be that stupid!!!

    If they dont get punished for this then there is definately something wrong with the system.

    I wonder if there is any way we can assist with the compliant, even though it dosen't directly have anything to do with us?

    That thread relates to First Credit Management (Evesham) not 1st credit (reigate)

    They are separate and different organisations, albeit working in the same area with similar practices

    Why they continue to use similar names baffles me.

    Both are CSA members who say they abide by OFT Guidelines!!!
