  • No, I'm not on a dmp. I wrote to my creditors, 4 in total, with an SOA and suggestions for regular monthly payments. They all agreed to this, and I've been making the payments. Then, out of the blue Goldfish passed me on to 1st Credit, who immediately made their usual demands. I've since made 2 payments to them, but haven't made any more since the 12+2+30 letter. I was quite happy with the arrangements I'd made, which were affordable, but 1C wanted £2000 immediately plus £280 a month  . This would have added an extra £2000 onto the original debt
 Jul 2008 debt £36,600 (not including mortgage )

they are breaches of the OFT Guidelines on Debt Collection. Download 11 pages from www.oft.gov.uk . Read, think about it, then phone them to Complain.
I'm guessing that you will find that they have breached the following,
    2.2b, 2.2g, 2.2h, 2.6b, 2.6f, 2.8d they normally do.

No probs. I dont know if you are on a dmp, I know debtman2007 is and he was asking for this type of letter the other day.
I have just prepared this for sending to 1st cretins tomorrow...

    Sirs,

    Ref Account Number ****************

I enclose for your attention a Default Notice sent under the terms of the Consumer Credit Act 1974. You have failed to send me, after proper request, a copy of the Agreement as required by Section 78 of the Act.

To pre-empt your response, whilst I do not need to give you reasons, I dispute the fact that you have any legal entitlement in this matter. Payments to you have been made, and maintained, via a debt management plan administered by the Consumer Credit Counselling Service and will continue as such so as not to jeopardize payment arrangements to creditors who do have legal entitlement. I reserve my right to request repaymant of any monies made to your Company as and when neccessary.

    Yours,

Thanks Pepe. That looks spot in. It will by winging its way to them shortly. :T
