Hi debt man
I querried wth ccs why was I paying two of the barclaycard debts not in my name (one at court level re ccj i am appealing- waiting from response from their solicitors- even though barclaycard head office confirmed verbally debt is not mine )
CCs said as it was still a debt and indispute it would look better if monthly payment made - they would not reduce it to a £1.00 token payment at this stage.

Been Paying Halifax via Blair Oliver Scott for 18 months then get a phone call out of the blue from First Credit.We owe in total £20000 They have said your payments are too small,after a lengthy phone call was then told it would be passed over to their Solicitors who would probably make me Bankrupt.This would have a really terrible effect to my life as I have a family and live in our own property.The property has no equity in it,and I cant see the point in this happening.As we are paying something the amount is £60 per month and cannot afford any more.Could someone please advise me what could happen or what is likely to happen.0

Standard 1st Credit procedure, threaten EVERYTHING beffore the debtor has a chance to find out their rights!!
Are you in a dmp ( CCCS or similar?) You will prob get numerous phone calls, then more letters threatening Statutory Demand and Charging Order, but they wont take you to Court to get a CCJ....they want to keep it out of Court if possible because thats where they will have to PROVE the validity of the debt.
They want you to beg, borrow or steal the money to pay THEM, the collections staff on the phones are paid commission so they dont giove a toss what they say ( they dont know what half the Legal Terms they use actually mean ) or how it makes you feel.
What to do?
Download from www.oft.gov.uk the Guidelines for Debt Collection. read them.
Write, recorded del only, or e-mail ( good because you get Auto response so proving delivery ) stating that you will only contact by letter. Do not speak to them on the phone!!.
Download from www.nationaldebtline.co.uk the template letter for the CCA Request and send it with a £1 Postal Order ( NOT A CHEQUE ) to their Reigate Address, recorded delivery
DO NOT SIGN ANY LETTER TO THEM.
Keep a log of EVERY contact with them. they tell you that conversations are recorded....but when it comes to retrieving proof of a breach of OFT Guidelines, surprise surprise, it cant be found.
Sorry to be long-winded.
No-equity gives you strength. Also when they break OFT Guidelines ( which they will ) COMPLAIN to OFT, its FREE and ANONYMOUS. they wont act on individual complaints so numbers make all the difference.

My update. 1st are asking Citi for a CCA again, 40-odd days after not producing from the first request. Good, because when it does not materialise again it will cement my case for non-payment.
Oh, and for the trolls out there....I never borrowed any money from this bunch of creeps, they took a gamble on buying old debts from a failing American Bank.:D stay wonky

They will always say payments are too small. They seem to like a monthly amount that will ensure that you clear your debts within 5 years.
Statutory Demands (BR petition) sometimes I think are the only words that Worst Crudit know and the only headed paper they own since they send these out like confetti. That said, it should be taken seriously as they have been known to follow it through.
If you can't afford to pay them any more then that's tough on them. They can't have what you don't have. I went round in circles with them for ages, they threatened me with everything (I have a property) so far none of it has materialised and they've been accepting my monthly repayments for some time now and I've not heard from them for about 6 months or so.
They are unlikely to take you to court for a CCJ as the judge will be likely to set payments that are affordable to you and not to them and they know that. Also, in terms of BR, they will just have to go into the pecking order along with your other creditors so they could end up with nothing or less than you owe any way.
Don't ever speak to them on the phone. Keep everything in writing. They will constantly reply to your letters asking you to call them...just write back and say you will not call them as you wish to deal in writing only.

Is it really worth complaining to this shower of ****? They just don't seem to care. Would be better to 'name and shame' them publicly methinks. Give them as much bad press as possible.

Malsen, Worst Crudit try and pull every trick they can. I found it helped when I spouted back all the rules of the DCA guidelines they were breaking and that I would report them - the idiot on the phone (not me!!) put the phone down!
As I say, they send SD's out like confetti which in itself, I believe is a breach unless they intend to follow it through and I'm also led to believe that they are not "served" properly. So usually Worst Crudit are full of hot air! They've tried everything with me, even saying they would put a charge on my mothers house and remove her stuff to pay my debt - well they've obviously not done their research as my mum lives in the US so I'd like to see them try! Haven't told them that - just told them to go ahead. After all, they are ones that look stupid.

if worst crudit do send a Statuatory Demand, please come back here for advice and get it set aside.
In the mean-time, have you sent the CCA letter? That effectively halts any legal action until the CCa is delivered.
Also if you have no equity then going bankrupt would not necessarily mean losing the house. The OR would consider wheather you could rent similiar for less than the mortgage payments and if that would enable you to pay an IPA. If not, then you or OH could buy the Beneficial Interest for about £225. So keep calm.If you've have not made a mistake, you've made nothing0
