First credit debt collection :(

Just to join on this (I posted similar to another thread).
I got a letter from BarclayCard saying they have assigned my debt to 1st Credit as of 1/7/2005!!!! (yes 2005!!!)A couple of days later I get one from 1st Crud introducing themselves and cough up. Amazingly the 2 letter arrived in the same style envelope and the exact same return address. Do they think I am stupid?
My question is do I send a "Prove it" letter or a CCA request?

Yess CCA request, and proof that they tfrd it then. Why did they wait that long? Unless they can prove by Recorded Delivery recordds that they told you back then ( service? ) then the Assignment can only run from the date they have just informed you on......I think

I have to admit despite the fact i know this £474 debt isn't mine, Would i not be best off writing to them to state this fact rather than simply ignoring their letters? I definitely have no desire to ring them having read of others peoples experiences.
As you can imagine it is playing on my mind somewhat, I guess this is how them manage to get money out of some people...get them to pay up simply to make them go away. Whilst i have no intention of doing this i would just like to make sure that i'm going about this the correct way.

They would love you to phone so that they could 'accept a lower amount'. Dont.
If you are 100% sure that this is nothing to do with you e-mail them ( you will get an auto-reply which proves delivery ) and then just sit back. if they try to go Legal, which they probably wont, then they will come unstuck then.
Check you credit file though, cos if they put an entry on there and its NOT your debt then they get in trouble. take a 'free' trial with Experian, then cancel it.:D stay wonky

Help re barclaycard please
Both these accounts are my husbands. But on 10 July 2008 received a letter Barclaycard transferred account into my name.
One of the accounts reached the stage of ccj. sort advice from c.a.b. who helped me compile the paperwork for ccj. They too were unable to speak with Barclaycard as they too got quoted data protection.
I received a letter from the court on 25 Nov 2008 acknowledging receipt of defence- also stating claimant must contact the court within 28 days of receiving defence. This letter is on headed court paperwork with full address.
I have received paper work re transfer of proceedings to local court and an allocation questionnaire to be completed before 02/02/2009.
Date on paper work 15 Jan 2009 . This is two papers on plain white A 4 paper and five pages on peach A 4 plain paper.
Contacted F.o.s. informed needed to have made an offical complaint with Barclays a ref number Phone call on 21 Nov with barclay head office
i was a very long phone call lasting between 1 1/2 - 2 hours. She was also corresponding on another phone to northampton Barclaycard.
I was informed that an error had been made at Barclaycard - that the accounts had been transferred to my name. Data protections was a problem as ccj paperwork in my name and account is in my husbands - she then spoke with my husband so she could access the information. My husband and I gave consent that either party could speak with Barclaycard as we wanted to resolve this as it had now escalated to a ccj.
We had twice wrote asking for a copy of credit agreement with the £2.00 for each account . both letters confirmed received at northampton office. -we have not received any correspondence.
We were told not to worry as they had sent in error to a third party CL Finance they would withdraw the paperwork the ccj would be stopped.
20 Jan 2009 0800282390 unable to speak with person of nov spoke with two managers! informed me that three letters have been sent by Barclaycard

20/01/2009 final response..
No letters have been received at our address manager 1 unable to resend letters as the complaint has been closed.
I asked if I could make a formal complaint in again told no as it was related to closed account
spoke with (?his manager) who will forward the two letters 18 Dec 2008 and 20 Jan 2008 by recorded delivery. But was not able to send a copy of 27 Nov 2008 as case closed.
That I had to contact customer service 08445560060 to see if anyone there would help resolve as the case is closed.
Have now emailed f.o.s. for direction to take.

In this situation I would send the "Prove it" letter. Always remember the onus is on THEM to prove it not you to prove you dont have the debt. The template can be found somewhere on this forum - I'll have a quick look since I have used the letter myself.

Just 1st Credit and not 1st Credit Limited? When sending monthly payments via postal order I assume I cross it and send it with that name too. Sorry I know I sound stupid but want to make sure they receive their monthly payment as they will not provide me with bank details because I refuse to phone an 0870 number or text and give them my mobile so they are able to ring constantly.
