HELP!! Been in a prang with a provisional licence holder!

    The only good thing about having the accident with this person is that I know her quite well, I went to secondary school with her!! lol

    That still won't stop her from saying that she wasnt there or involved in the accident. A guy who lived 3 doors up the street hit my dads car outside our house, My mum saw him do it and he admitted to it and offered to get his uncle to get the car fixed, we looked in to the bodyshop he uncle worked at and decided it wasnt going to happen that way. My Dad had only had the car 6 weeks so not pleased he got a few quotes from local recomended bodyshops and handed them over to the guy who said he wasnt paying that so it went through the insurance. The guy is denying hitting my dads car even though in front of my mum and dad he admitted it. this is still ongoing.7 months on.

As soon as I had the accident I told him, he has been keeping an eye on things as I don't live in that area. She was only 20 foot or so from her house & his. There are traces of my car all over hers and vice versa.

    I suppose there is the fact that there aren't any eye witnesses, but I do have numerous text messages from her appologising for hitting me.

    We'll see.

    If she denies that you had the accident atleast you have the text's as proof also the damage to her car and to yours. There is no way of her getting out of this now!

    I would carry on with the insurance side and dont listen to characters like Dippychick? they live in a different world when it suits them, and you could end up with a criminal record for fraud for something that started out as not your fault.

    In future if in a bump you could call the police. My boyfriend (a police man) is worried about me as round where he works people bump cars intentionally, then when you get out they carjack you.
    He says I should call the police, stay in the car and wait for them. Then at least they would PNC both parties and would have realised the licence error. There is also a permanent record of the collision with the police.
    It also helps as some people give false contact details (and may be on false plates).

    He said if I am really scared, to carry on driving (if possible) and go to the nearest police station and report it to them.

    Oh dear. The insurance company will undoubtedly write it off then. Is that a good or bad thing for you, OP?
  • Hi guys! It's been a while!

    Anyway, the car was a drivable right-off as it was only cosmetic damage.

    Her insurance company have paid out for the car & my solicitors are just waiting to hear back from them with regards to my injury claim.

    Good job you didn't listen to Dippychick then. As several of us said, insurance companies cannot easily evade third party liability even if their policy holder is driving illegally.

    Incidentally, thanks for getting back on this. It is rare to read follow up posts.
    I used to think that good grammar is important, but now I know that good wine is importanter.
