    Pursue your insurance claim.

    With luck she won't be able to drive for a long time.

  • Ok what would i know;) Fine if you think she is insured!!! think i'll just go out and drive an Artic on my provisional class C it'll be fine as long as i insure myself but fail to abide by the terms of the insurance i'll still be insured by your logic. Baffoon:rolleyes:

    Come on Wonga! Calling someone a baffoon is a bit strong, especially when you haven't even read their post properly. She will not be able to make a claim, but the third party...thats me btw...will be able to do so on through her insurance company.

    Exactly! Please ignore any poster who says that the third party's insurer will not have to settle your claim - it is bunkum!

    . By your logic i could insure an articulated lorry and drive it about and still be insured even though i have no licence for such a vehicle.

    I notice you removed the fact you implied you have a provisional Class C licence from the above. Is that because you realise I've had a C+E for 15 years?

    Given that this appears to be the sum total of your technical insurance knowledge, I'd say not very much. But, rather than simply disbelieving me, I would recomend that you actually read the relevent section of the act before advising me that I am wrong.

    I'm slightly surprised she admited that she was just a provisional driver. If I had been in her shoes then I would have just offered to pay.

    The thing is is the costs might be outwith her means and therefore any payment might not be forth coming. If you feel there could be a problem it might be better to err obn the safe side and go through with your claim. However be aware that at this point she will probably claim you were at fault with no witnesses and it could be split 50:50 and might result in loss of NCD.

    This is hard one taking the money and running could be tempting. If it was me I would be seeking as much advice from the industry as possible and if I couldn't get it elswhere I would probably discuss with my own insurance company (might need to get up the corporate ladder a bit though to get a factually accurate answer).
