    she did offer to pay for it, but it was thru her brother doing the work, thats a huge no-no to me

    i would not believe a word they say- best continue with claim, and cover your own back.

    I have to wonder what else are they hiding from you
    -did you actually see any licence?),

    or the insurers
    -surely couldn't get a car, WITHOUT arranging cover..?

    - the police?
    - other points / banned already..?

    By not having a suitably qualified driver with them would probably b***er up any future claim for them anyway,

    and cancelling your claim may (or may not? just guessing on this) be
    flagged up in future, should you ever need to make another claim..

  • Hi guys! The stiffness is getting worse!! Oh the joy!

    I can confirm that she has a policy in her name, I called her insurance company last night - Who confirmed this. Just put my forms in to the solicitor, see what happens next.

    OK go to your doctor and get treatment for your injuries, pain killers etc what ever is needed. It will back up your injury claim. advice is if you want to make a claim for injuries a paper trial is brilliant evidence ;)

    So what to do now. Stick with your insurance claim, that is the only way to guarantee getting you car sorted, if it is repaired and something goes wrong they are liable for putting it right. Another reason for not letting the third party's relative to fix it, would they be prepared to ensure the work is done to your satisfaction especially if they are not going to be paid the going rate for the work they are doing.

    If the third party wants to get round them getting the claim against them then they are welcome to repay their insurance company the cost to the claim. but that is up to them.

    The third parties insurance will cover them for claims made against them so they should pay up. As you have no whitenesses this could be a problem, you need to make a detailed description of what happened, road conditions etc include a description of the driver to prove that she was actually there if you noticed any distinguishing marks or anything on the person or their car it all helps prove they were there. so they can't turn round and say she wasn't the third party.

    She doesn't want it to go through the insurance because she has broken the law and will possibly lose her licence before she has even passed.

    You could be generous and let her say she was in the car with an experienced driver - which would mean you can claim off her insurance.

    Because you aren't doing this, and you arent taking the money to pay for you repairs - you will have to claim off the criminal injuries board wont you?

    she knows she shouldnt have been driving alone
    obviousley she cant drive!!!

    she is now trying to commit fraud !!!!

    this should have been reported to the police!!!

    Failiure to report an accident, fraud, driving without valid licence, driving without valid insurance, dangerous driving .


    i would not be happy getting her off any of these offences

    Very, very bad idea - that is fraud - and not necessary anyway. The other insurer will have to settle the claim regardless of whether the other driver was supervised or not.

    Please don't take any notice of Dippychick, who sounds very well named! If you are 'generous' and kept quiet if she lied about being accompanied by a licensed driver, you could be had yourself for conspiracy to pervert the course of justice. And you will NOT have to claim off the criminal injuries board because, as Conor and others have patiently and correctly explained, her insurance is obliged to pay out third party claims even if she was driving illegally. It is very hard for insurance companies to escape liability on third party claims so long as the premium has been paid.
    I used to think that good grammar is important, but now I know that good wine is importanter.
