Have to say CBK are the worse cashback company I have dealt with. Unfortunately it was my OH's first venture into the cashback world and he is less than impressed.

Where did you see this? If you actually read the response CBK say that if M&S have a good reason not to pay out, then they will support that. It's going back on what they have agreed to do i.e. pay out of their pocket.
They should pay out immediately and then deal with the legalities afterwards with M&S. Every time I look at the forum, they change the boundaries.Mortgage start September 2015 £90000 MFiT #060 -

i'd cross the "good reason" bridge when you come to it - to my mind, that could only hold if you've done something that doesn't fulfil the original conditions when you went for the offer... else just threaten to sue them as I did if they don't play ball; their Ts & Cs would be laughed out of court

We've done all that...filed a claim a long time ago and PM'd James (CBK then put an added response about declines). As far as I'm concerned they should be paying out to everybody. The 'good reason' is just another way of getting out of it...'Oh M&S declined your transaction for good reason (but we don't know what they are so can't tell you)'
I would expect their t&cs do cover them. I guess they are along the lines of..we can't guarantee payment. Contract is between ourselves and merchant etc.although I shall take great pleasure in proceeding when they do refuse paypout again.
I'm not a fan of Quidco either - had to send them evidence that they had paid me incorrectly and that took months to get through to them.Sticking with TCB for the time being but won't be returning to CBK.Mortgage start September 2015 £90000 MFiT #060 -
