have received confirmation of your order in the form of a receipt confirming details of your order
I read that as the order confirmation email is the receipt as its then that they take the money.

"No contract will subsist between you and Virgin Retail Limited for the sale by it to you of any product unless and until you have received confirmation of your order in the form of a receipt confirming details of your order. Once the receipt has been received, there will be a legally binding contract between us."
So when do you get the receipt? All they send out is an order confirmation email, I take it the receipt will come when they send the item, therefore, if they never send out the item, you never get the receipt, and they never get into a contract with you.
Ive still had no response from them, I ordered at 19:00 on friday.
They did take the money from my cardon the 22nd then returned it today.
The order confirmation is the receipt, as it details the item(s) you've ordered, the Order Number, it states that you've placed the order, and informs you that payment has been taken.
Looks like a receipt....sounds like a receipt...... ;D0 -

And to all the naysayers out there, remember the Woolies phones, the thread went a similar way but in the end Woolies got their act together and came up with the goods for all reasonable orders so yes these deals do come off, you would think that some "client awareness unit" at Tesco would be sat down around the family circle and cheap ground coffee pondering over the outcome of this little fiasco, would it be :

Most definitely! I think we all would have left it if Tesco had admitted it was a pricing error as their own T's & C's cater for this eventuality.
Let's face it, the Gamecube will probably be selling for around £50 after Christmas anyway so they wouldn't be losing much.

Law of mistake will probably be argued, and probably with good grounds. They (all the sites) did not intend to sell the packages at £34.99 and when they realised they pulled the packages.
They will go down the lines of we thought we had supplies, but when we realised we didn't, we pulled it off our websites. Those who ordered, we apologise.
The thing about a new pack selling at £100 (or whatever it is), well its a different package. Might contain the same game, etc, but as far as I can see it's packaged differently and has a different product code.

I emailed virgin earlier this morning asking why money had been taken from my credit card then refunded. The response was " the item is no longer available from our suppliers".
I take it from this some people will be getting it for the misprice. Because surely they wouldn't just say that they could not get it, would they?
Its also been taken from the website, no doubt it will sneak back on in the next few days at full price.0
