    I have received this email today from Virgin:

    I am very sorry for the disappointment and frustration that you felt.

    Please note that as stated in our Terms and Conditions, all our orders are
    subject to availability. Although we do not wish to disappoint any of our
    customers, if an item is made unavailable by our suppliers, we have no
    choice but to cancel any orders for it.

    Once again, I apologise for the disappointment and frustration that you
    felt.

    Please feel free to contact us again, if you have any further questions..

    which is one they sent to someone else on the forum.. they are just sending out standard emails which is really bad..

    I have emailed them back telling them that they have breached contract.. and that the contract is between me and them NOT their suppliers.. also that i will accept one of the other bundles which is showing as available and ready to be dispatched in 48 hours.. and i have started legal action..

    i will actually start looking at the small claims court.. so if someone could put a screenshot of the virgin bundle so i can print it out.. that would be great..

    Virgin never had a picture of the bundle on the site... but I was sneaky, the first email I sent back I included the items I thought were in the bundle (what I could see on the picture on tesco's site) They have not argued what the bundle should of contained. :-)

    i know Ian .. but it still said Bundle.. in the description..so it proves that it was the bundle they were selling..

    so it would have been good to have a printout of that page..
  • Virgin have surely admitted that the bundle they were selling consisted of a console and pokemon game because their using the - no hardware now available- excuse. Even though they have >:(

    After this automated email was sent out, we were made aware that we would
    not be receiving the bundles as featured on our website. As soon as this
    was confirmed we began emailing our customers detailing the unfortunate
    need to cancel and refund all orders placed for this bundle.......

    oh virgin....

    queried them too...

    how could they explain the fact that upon receiving my cancellation notice, my cousin took his chance and was still able to place order on this, which of course later on cancelled by them too (took them only 3 hours to do so, despite specified 7-14 days delivery est.). and even after that time, item remains & can still be ordered.

    my point is, they could have just pull the featured item on their site immediately. else, they surely have vested interest for retaining it; collecting new customers' details & everyone's money to use for their business for a while (?).

    My complaint has been sent.

    If everyone emails their complaints it will make them think twice about doing it again.........especially when other customers complain about the slowness of their email respeonses

  • No, Virgin didnt have the picture but the wording was incorrect so you may be ok.

    However, their email response is rubbish....basically forcing their problems onto the customer. Who cares if they cant source it from their supplier, that is NOT the customers problem. Any offer has been made and if money has been taken from your account that is Virgin's acceptance as far as i concerned. If they dont fullfill their offer then you could buy the same deal elsewhere at their cost, though you should agree this first giving them a deadline to pay up.

    I am disappointed with your response. I have made an offer and it has been accepted by your company, Virgin. However, you have cancelled my order without my permission.
