I am no legal eagle but as far as i know...am i talking from delaing with 3rd party contracts at work
if a trader online or not has taken money from your account...that is a formation of a contract..so you may have a case to get the item from them or elsewhere and they pay....problem is i idont think there is a legal precedent on this which is why the law is a little woolyStevie Coppell's record breaking blue and white royal army - championship winners 2005-60 -
I had a similar problem with Britannia music a couple of years back. THey took my money for a few DVD boxsets that they had in an offer, then decided that they had got the offer wrong. I would have let it go, except they lied and said they had been delivered and I had sent them back!
My wife is a solicitor, so we issued a small court claim for loss of bargain. The company backed down the day before the case went to court, so I got The Godfather DVD box set and £130 for nothing.
I think if companies make a mistake, then own up and say sorry it is fine, but when they lie or don't contact you they deserve everything they get.0 -

If they have taken the money I think they have 30 days to deliver the goods under the Distance Trading Regulation.
Logically you could say they are guilty of theft.
I agree that if they say sorry or say there was a problem, then thats ok, but if they ignore you or lie they deserve being taken to the cleaners!

Hmm, I ordered one from Tesco and one from Virgin. I didn't really expect to get them but I did expect it to be handled better than it has been.
I too have had money taken from my account by Virgin. Surely they're in breach of the DSR by taking money when they can't supply the product?if i had known then what i know now0 -

Please note that as stated in our Terms and Conditions, all our orders are
subject to availability. Although we do not wish to disappoint any of our
customers, if an item is made unavailable by our suppliers, we have no
choice but to cancel any orders for it.
The back order email your friend received is an automatic email that gets
sent out to our customers as soon as an item is ordered. This automated
systems doesn't take into account that this was a preorder and as such
generated a 'return to stock' date of 28/11/04.
After this automated email was sent out, we were made aware that we would
not be receiving the bundles as featured on our website. As soon as this
was confirmed we began emailing our customers detailing the unfortunate
need to cancel and refund all orders placed for this bundle.
Once again, I apologise for the disappointment and frustration that you
felt as well as for the confusion our automated emails may have caused
either of you.
You have been refunded £32.99, 22/11/04.

With regards to your further email, as per Sale of goods act I expect these goods within 14 days of the above order date, failure to comply with this order shall result in trading standards investigation as i have already been in touch (forwarded all the relevant information) with them and have been informed to advise you of the above. Monies taken in exchange for goods are a legal contract, no refund has been made to myself and i stated prevoiusly I did not want a refund but the items I paid for.

Had a simliar email chain with Virgin.. In my last one I offered to accept a simular bundle made up from the other two gamecube bundles that they have available online :-)
See if I have any response when I get home.
