  • This new email from virgin regarding not selling hardware in general is a load of lies. What about the other gamecube bundles on the web site(see above) and the stuff in store - gameboy and xbox bundles (ok PS2 is undoutedly out of stock).

COME ON VIRGIN AT LEAST MAKE A BETTER EXCUSE

here's my explaination, i asked for a similar bundle at teh same price, or for them to give me the ££ difference between their price & having to buy it through amazon.

I am very sorry for the disappointment and frustration that you felt.

Please note that as stated in our Terms and Conditions, all orders are
subject to availability. Although we do not wish to disappoint any of our
customers, if an item is made unavailable by our suppliers, we have no
choice but to cancel any orders for it.

Once again, I apologise for the disappointment and frustration that you
    felt.

    OTT or what?

For clarity, the above quote was in response to a fax that I sent to Virgin. I don't believe it was OTT, just stating facts. However, so as not to start a flame war, I've removed the original post.
  • Addys done right, I've been back in contact and pointed out their t+c's, forming of contact etc, and their denial of selling hardware is misinformation. Awaiting their reply. >:(

  • So you're going to buy it from elsewhere and claim the difference back from Virgin?

All this for a gamecube?  ::)

Maybe this will clarify the situation, at least with regard to Tesco.

This was a reply received to my email to Trading Standards, querying the legalities of the matter. Again, I want to point out it was for information only.....I don't give a toss whether I end up with a Gamecube or not and I'm certainly not going to make a song and dance about it. I was just interested to know the legal standing.

A trader can refuse to sell a product to any consumer for whatever reason.  In such a case any money paid to the business should be refunded, as they have done in this case.

If an error is discovered or a mistake made then they should ensure that the matter is rectified, I understand from your e-mail that they have removed the page from the website  *in attempt to avoid further problems.

    * (Their words, not mine.)

I am afraid on this occasion I cannot add anything further to the advise you were given previously by Consumer Direct.

(The email was a follow-up to a telephone call, as web page links were sent.)

So I think everyone should just accept an error was made and move on, as it looks like there's no comeback anyway. Some you win, some you lose.....I think this one's a dead horse, time to stop flogging it.  :-/
