    A trader can refuse to sell a product to any consumer for whatever reason.  In such a case any money paid to the business should be refunded, as they have done in this case.

    I think that's not exactly right. They could refuse to sell you something sure but once they take payment they have formed a contract (of sale). Past this point I think you would be entitled to claim for "loss of bargain" if they choose not to fulfill.

    As I say - this relates to when payment has been made.

    I can only go by what Trading Standards told me. :-/

    I did make the situation clear and explained all the steps fully (i.e from point of order onwards), therefore they were aware payment was taken and subsequently refunded.

    I also sent page links of 'before' and 'after' price so they were aware of what was involved.

    If there was another avenue open to us as consumers, would they not have pointed it out? :-/

    I think trading standards must be in error logically and legally. How would the world function if contracts were legally allowed to be terminated on merely a whim. You turn up at your new home to find the sellers have changed their minds and tough?

    I think not.

    Whilst it is reasonable to accept a mistake and ever since Kodak we've all jumped in both feet first at every sniff of blood and whilst this is maybe morally iffy it's the nature of enterprise since time began.

    I think that company's have T&C's to clarify and protect both them and us. If we break them they are entitled to terminate and likewise they make adhere to them. However, if a large corporation says no then there is precious little we as individuals can do. What power we have is en mass using the power of publicity and that is where a site such as this is superb.

    Large corporations must stop hiding behind their size and just get over themselves. If they make a mistake, learn from it and move on

  • My first post on here as I found this great place though a link.

    I placed 2 orders with Tesco -

    First one at 1pm on Friday and got the confirmation at 1:15pm.

    Second one at 1:30pm but didnt recieve the confirmation until 12 hours later ???

    I havent yet had the infamous cancellation email!

    I've had replies to two of my emails to Virgin today, both along the "sorry you were disappointed" line.

    I was surprised too, by the advice given by T.S. to Aliasojo. I've emailed my local office with the Virgin story to see what they come up with.

    Lol! Actually, I don't think we need to fight with them....depending on what they say to me of course, we could set up a "fight" between them and stand back and watch the fun  ;D

    Added - just to explain - the "fight" I had in mind was a la Harry Hill, that part of his programme has me in stitches :D

    my order with wolwoorths is saying "pending verification" what does that mean ?...are they checking my card ? or does it mean something else ?

    I ordered via tesco, got the email saying they are not going to supply the gamecube, etc. however i did it via rpoints, got some rpoints points today, so got something for nothing (kind of, only got 43 rpoints, but better than nothing)...
