i emailed them saying i will have one of the other bundles.. and provided a link for it in my email...
checked site this morning.. and all bundles removed..
luckily i took a printout of the Metroid Bundle which was showing as redy for dispatch in 48 hours..
iv also emailed trading standards just to see where i stand..
i dont think we will be getting anywhere now.0 -
I have had a phone call from my local Trading Standards saying they are referring the matter to the Home Authority (I take it wherever Tesco.com is).
On a different note, I don't think any of the companies can now argue as price mistake as a reason for rescinding or avoiding contracts, as this was not stated in any of the email. They all seem to be saying that they didn't have the items in the first place!
I'll keep you posted about my complaint to Trading Standards.

Wonder if they'll be happy to withdraw all bundles from sale till it goes to court - it can take months for the wheels of justice to grind, lol.0 -
well just got off the phone to cust serv at virgin.. beasically he said their t&c states all items are subject to availability and they take payment 1st regardless if item is ion stock or not. if an item is showing as 7-14 days then it means not in stock.
he said their suppliers cant get them and will never be getting them. i asked him why the other bundles were removed this morning.. and he said maybe thier suppliers couldnt get those either.. i asked about the one that was in stock .. and he said they prolly sold out. i then said if it was sold out then it would say 'sold out' .. and the page wouldnt just vanish into thin air... he didnt say anything.
i also stated that other companies were selling this bundle for £99 adn asked if you had made a pricing error. he said no pricing errors were made at all.. that is the price they were selling them at.. but they will never be getting any at all.
i told him i have contacted trading standards.. and i will wait for a reply from them.. he apologised.
so i think they have won this one.. as he kept pointing out that all items were subject to availability..
ahh well.. i'll see what trading stan says0 -
AFAIC, and until I'm informed otherwise by Trading Standards, Virgin can quote the "subject to availability" line till the cows come home. They took payment and that is when the contract to supply is formed. If they can't supply they shouldn't have accepted my Offer to Buy.
Argos are still selling them, so it's nonsense they can't be obtained.

They'll just use the old "website and stores are two completely separate entities" excuse. Like Boots not fulfilling my digital camera orders despite them being in stock in store. And Tesco in store are really good, cos if they price something incorrectly they give you the item for free! Doubt Tesco online would do that!
Plus there's plenty that Virgin do sell in the shops but don't online.
Good try though!One thing I'd really hate....is to have a nail banged through the back of my neck.0 -
we should all buy from tesco and woolies at the new price. then return them as being unwanted/protest. that'll teach them a lesson as they wont be able to sell them as new.

I ordered this from Tesco and a couple of days later I received an e-mail saying that they could not process the order, I then phoned their Customer Service to ask why the could not and was told that this was a mistake on the web site and the supplier had let them down, now I will not give Tesco another penny but instead visit my local Asda, I also found the Tesco Customer Service most unhelpful all through my phone call.
Sorry I did not realise that it had happened to everyone else as I just read the first page and nothing else, still good to see so many people up at arms regrarding this.0
