    Could someone please clarify the situation as regards those of us who ordered from Woolies?

    I received the following from their CS:

    >>Unfortunately, our suppliers have informed us that they are no longer able to supply Pokemon Colosseum Black Bundle.

    Please accept our apologies for any inconvenience or disappointment.

    As it is our standard policy only to charge for products when we are notified they are available for dispatch, you have not been charged for this product.

    The status of this product has now been updated to No Longer Available and the item effectively cancelled from your order.>>

    So is it because they didn't take payment that they are off the hook as regards T&Cs? I ask as they have not admitted a pricing error, they are saying there aren't any of the bundles available. Is this true? And if it is not true is there any recourse we can take?

    does this count for tesco and any other site who got caught up in this before i make a prat of myself.

    You may want to seek your own advice, but my understanding is that the clincher is IF THEY TOOK PAYMENT - that's when they accept your Offer to Buy.

    Indeed. btw Virgin can include any t&cs they like but they may well fall into the "unfair terms in contracts" in which case they have no bearing.

    payment = acceptance = contract.

    failure to supply = claim for "loss of bargain"

    Did it with skybuy in similar circumstances (they paid up before court).

    I would suggest you contact Virgin again with an ultimatum.  Feel free to use any of the non-personalised information from my fax to them that I copied above.

    Any supporting evidence should be kept - order acknowledgement, emails etc.  If you have a screenshot of their offer that would be useful although the ack. will contain all the same info.

    I would just like to say that if Virgin had been more reasonable about this, I'd probably have let it drop.  I have no personal interest in devoting hours of my time and going to court for the sake of around £75 - but it's the way they've ridden roughshod over consumer's rights and chosen to blatently flout the law that's got my hackles up.  And it's not just my order, I wouldn't like to guess how many of us there are in total.  

    Large companies are not beyond the law.

    A mate of mine just phoned me to say

    "he reported Virgin to Watchdog, and just received a telephone call requesting copies of his mails and documents Web screen prints."

    The they have contacted virgin also and asked for representatives to answer questions on TV.
