Addy I have emailed Virgin and told them I thought they were in breach of both T&C and DSR, do I need to contact TS with all my correspondence or just continue to pursue with VirginNice to save.0 -

I suggest you contact Trading Standards and recommend they take an eye test
as Virgin T&C are quite clear

I have recieved a letter today from Tesco stating that they have not formed a contract until the goods are despatched and if the goods are not available they do not have to supply. It is a whole A4, but basically they are standing by their T&C's.0

All that is made redundant by the fact that a) they say that the order is legally binding and b) I made an offer to buy which they accepted by taking payment.
The officer at the T.S. Office was in no doubt about it -I'd provided him with all the information which he'd reviewed in detail!0 -

I write further to our recent emails and other correspondence in respect of cancelled ORDER ID *******.
I wish to inform you that I have sought further advice from Trading Standards on this matter. They have this morning confirmed beyond doubt that you are in breach of both your own Terms and Conditions and the Distance Selling Regulations.
Trading Standards have informed me that in order to resolve the matter, you have three alternatives.
· You can provide the goods as ordered
· You can provide an acceptable alternative
· You can negotiate compensation for “Loss of Bargain”
Please advise me within 7 days which of the above alternatives you wish to offer. In the absence of any such offer, I will have no alternative other than to purchase the goods elsewhere and initiate proceedings against you in the Small Claims Court.
May I strongly advise that you seek further legal advice in this matter. Should you wish to confirm the situation with Trading Standards, please contact Mr B***** at Cambridgeshire County Council (Trading Standards) on ***** ******* and quote reference number ******

To be honest it doesn't matter what anyone does as they won't have enough stock in order to satisfy everybody, even if you do take their 'in-shop' stock into account.
This was meant to be a pressie for my step-daughter for Xmas. However, with all the problems, even if they do honour some of the orders chances are it won't be until Xmas 2005, when the gamecubes will be worth less than £30.
If anything they've probably lost a lot of potential future customers. When I tried to buy something that was miss-priced at streets online they said sorry and gave me a voucher. Fair enough I thought..and I was happy with their service and comments.
However, Virgin & Tesco have played this one very badly and the chances that I will venture to buy something from them again are extremely slim, ie, non-existant.
You would have thought that they would have been able to come up with some compensation package to say sorry about the mistake at the very least.
Good luck with Trading Standards, but to be honest I don't think that Virgin will budge on this one.Baby Year 1: Oh dear...on the move
