    The bank may have stopped it, just to be on the safe side. I remember that the bank stopped some of my credit card transactions one evening when I was being a bit of a shopaholic because it was not my usual spending habits. I was really peeved off at the time because the items were on special offer. But actually the bank were quite right to do what they did (as if it had been fraudulant activity I would have been angry at the bank).
    Sorry that little story probably isnt helping you much. But I think once you know what happened with the bank & you can pass this onto the landlord you will feel better.
    Also dont pay him the extra fee. You actually dont know whether this is the penalty he received. If he is late repairing the things that are broken are you going to then fine him.
    It is hard if you dont have anyone that you feel you can chat to. But remember you've got loads of people on this forum to chat to & we will try to give advice.

    I for one thank everyone for this site because I have learnt soo much from being here. Sorry to hijack this thread but if my LL didn't put my deposit in that scheme (i'm sorry i'm not technical) does that invalidate my tennancy?
    Also I think my LL is great, haven't had a problem with anything so should I even be worrying about it?

    Moodydonkey - the answer is no, it does not invalidate your tenancy. If you have a good relationship with your LL and your tenancy started after 6 April 2007 just write (keep a copy) and say that you understand that s/he should have registered your deposit but you haven't had any information from them. You can contact the schemes yourself to check via your property address: http://www.direct.gov.uk/en/TenancyDeposit/DG_066391

    Good to hear that you’ve learnt a lot but agree it’s not good to hijack this thread so hopefully any other replies will stick to top_drawer’s queries.

    For future ref you can simply click on the blue “new thread” button on the top left of the HBR&S board to start off your own - it would probably be best to do this, as the issue of when and if deposits are registered can get a hefty response from some very determined posters and top_drawer needs people's support in this current thread :smiley:

    On your tenancy difficulties there is the CAB in the Town Hall Annexe and you could also get help from the local Council’s Private Sector Rentals Team. If you have repairs issues always put them in writing to the LL and keep a copy

    hi,

    What would happen if I just moved out?

    I have spoken to my Dad and he has said I should tell him to push off re his "late payment fee" I am supposed to be here until the 20th but cant move into the new place until the 10th of September. However, the same day I looked at the house I accepted I also looked at another and although it was quite a bit more expensive it was within my budget of £300 (the first is £235). I could move into that pretty much immediately ... is it sort of devine intervention? I decided on the first because of price, closeness to work etc but the other is also within a bus ride and within budget.

    On the other hand I could move out and go home for a couple of weeks ... which would leave me commuting Darwen to Preston (cost £8 a time and about an hr and 1/2) and then move to my new place.

    It seems so damm unfair, it was not my (entirely) my fault. he didnt receive any rent at all from the DSS teneant who lives here for 3mths and even then he never asks her to pay the additional part she is supposed to pay as the HB peeps wont, she has run up a £150 phone bill which she has so far paid £10 off !!! and he's getting at me like this for a genuine mistake.

  • By all means you can move out if you are not happy in the house (e.g worried about boiler/electrical wires) but you will still be liable for the rent until the expiration of your notice period....

    You say you have gave notice on the 20th (July?) once you have paid the rent you owe.

    If it says in your tenancy agreement the late payment fee is £25 then I can't see how your landlord can charge your £50.

    I would just pay him the rent but asap (if you pay in cash make sure you get a receipt).

    Hi Jen,

    Given your overall financial position (e.g. overdraft - no money for food etc) I think you should think a little bit longer term. e.g. go with the original flat (who's tennancy agreement you have signed) as the extra £65 a month could be the start of helping get you back on your feet. It's not much but £780 saving in rent would certainly be a start. You also maybe need to think more broadly about your financial position and how you can avoid this in the future e.g. a £55 charge completely screwing you over. Why not start having a look through the debt-free-wb board for ideas on how to get yourself sorted.

    I'd contact the bank. Say to the landlord you'll pay the £25 in your contract, and move on with my life Best of luck!

    The LL has my deposit which he hasnt put into a deposit protection scheme btw so really the rent for up until the 20th is covered with that...

    he doesnt want £25, he wants £55.

    If he was reasonable then yes, all this sounds excellent but he isnt...

    it seems the only solution is to move asap and let him keep my deposit and move in on the 10th into the new place.

    I havent signed any tenency agreement yet with anyone .... he asked for me to get refs which I have done.
