I am sure this will be on here somewhere so apologies for posting if it is.
Boyfriend has received a debt collection letter from Spratt Endicote demanding payment for a months subscription to Click and Play.
He did have a payment to Click and Play appear on his account last year, which he queried with the bank as he hadn't authorised it. They refunded the money, closed the account and he had to set up a new one. He had a paypal payment taken from the same account for another relatively small amount and this was also refunded, paypal account closed and new one set up. He was at the time completely unaware that anything had been signed up to with Click and Play.
When he phoned Spratt Endicote they told him that the demand was for a monthly payment, and the e mail address the account had been set up against. This wasn't any of my boyfriends addys and he has never had one the same (similar but not the same). All correspondence between Click and Play and whoever had set up the account was via e mail to this address (as that was how it was requested at set up - Click and Play told B/f this when he phoned them). However who ever hacked his bank details got his home address as that was how Spratt Endicote got in touch, and I assume other details too.
Click and play basically dont believe him. He has a letter from the bank explaining the fraudulent activity last year but cant get anything from Paypal as the account that was affected is closed (thats what paypal are saying). He has also reported it to the police, but as he has had the fraudulent transaction refunded by the bank, he isn't out of pocket, so the police are reluctant to take any further. He got an incident number though.
I want him to write to Click and Play quoting some sort of legislation, because I am sure he must be covered by something as the account was set up using hacked details, and without his authority. He is worried that this will show on his credit history.
Stupid thing is that the amount owing is only 20 odd quid and it has probably cost more for Spratt Endicote to do what they have done already!

Send a recorded delivery letter to Spratt Endicote addressed to the MD. Outline the full details and tell them the matter is nothing to do with you and you will regard any further dealings as harassment. Tell them you want a letter stating the matter is closed. Keep a copy of all correspondence in case it goes on.

Thanks - I have now sent a letter by recorded delivery with reference to the sale of goods act stating that I am giving them a week to either remedy the fault or provide a full refund, or else I will have no choice but to take it to the small claim court.
Will keep you posted as to my progress.

The garage replied with a letter of their own claiming they are going to take the scrap dealer to court for the money they paid for the replacement engine, and they are now offering to rebuild my original engine at no additional cost. Frankly I have lost all faith in this company so am I obliged to let them do this? Based on prior experience it will be weeks, or more likely months and I still am not guaranteed to get a working car at the end of it.
Having given them fair warning (week's notice as per letter above) should I just go ahead and take them to the small claim's court?£25,040 of credit card debt cleared!

well i would wait for other advice but perhaps making up an agreement with time scales for repairs and penalty clauses would be a solution?
eg give them 4 weeks to have the car full fixed and road legal with a full breakdown of works carried out and warrenty on parts/works done?0 -
Hi all, Just want to check where I stand on this (minor compared to the others Ive readon here!) issues. I bought a sat nav (binatone) off amazon in 2008. I'm on my 3rd replacement since then due to it basically being crap. each sat nav developed some kind of fault and so i asked for a replacement. im not on this 3rd one which yesterday could not find me a route for somewhere. it has previously found me this route so you can imagine i was like, what?!
it's done if before but it seems to be more frequent now. even the google maps on my mobile found me a route! i'm using the sat nav correctly, it had a strong signal, no unusual weather etc.
ive emailed amazon saying ive had enough and i want a refund but they're saying no as the warranty's run out. but they're taking the start date of the warranty from the date of the original (1st) sat nav i bought in 2008! surely the warranty should run from the date of purchase (or exchange) of the last sat nav?0 -
no warranty runs from date of purchase
replacement units are covered by the original warranty
if you want to argue inerrant fault thats a different matter but for warranty its as i said0 -

Hi all, I was hoping someone can help me with a small problem I have.
I ordered a keyring from the website minimee.co.uk around the middle of January but still haven't received anything. I sent a polite email at first which was ignored and then a more forceful email after that which has also been ignored.
The fact is I'm pretty much resigned to losing the £25 I paid to them. The thing that annoys me though is that they are free to carry on ripping other people off. There are no addresses, emails or phone numbers on the site so I can't contact them directly, just a private message service.
Is there any place for reporting these dodgy online companies? I suppose this forum is a start but this company will continue to take peoples money until they are shut down I fear.
If anyone has any idea on what I could do I would be very grateful to hear them.
