    Hi I hope some one can help with this or Martin himself!!!

    I recently ordered a tv over the net. I cancelled the order within the seven days.

    Pick up was a pain.... DELAY, DELAY,DELAY.I was told by the company I would get a FULL refund.

    Now I did notice that I would be liable for a collection charge.

    I have read the DSR's re refunds. They state that compainies must give a full refund, no deductions for admin, damaged package, restocking.

    They can charges a returns fee though, (I have no problem with this) but they cannot deduct this from the price you paid. They must take the money separate for the returns and issue a receipt. I think its Regulation 14.


    Can anyone or Martin tell me if when I contact them because they have deducted the returns postage from my purchase amount am I right in asking for that money back.. under the DSR and as they didn't ask me for any money to return the item could I now refuse......

    I used my Debit card for this... alos the DSR's say they should not wait until they received the item back before issuing a refund, but they did, never mind.

    What should I do next?????

    Was the collection charge mentioned on their website? If you owe them a returns fee does it really matter how it is paid? Seems simply for them to deduct it from monies returned to you.

    Hi, I'm after some advice please.

    I purchased a steam generator iron from Robert Dyas sometime in Jan 2008, in Feb 2009 the iron went wrong. I rang Robert Dyas and they said I would need to contact the manufacturer.

    I contacted the manufacturer, I was told to send the iron back and they would look into it for us and replace the iron of which they did. Now the iron they sent us (in Feb 2009) went wrong about a week ago, (it just went BANG with sparks coming out of the iron part.) I rang the manufactor again and was told to send it back to them and they would check the fault and send out a new iron as it is under a year old (it cost me just under £10 to send it back) the lady also said they no longer made that iron but would send me one that replaced it.

    Today I got letter saying the year guarantee starts from the purchase of my 1st iron????(Jan 2008) and they can offer me a new iron at 60% discount off the rrp. Also if I want my old iron back I need to pay them £5.50. If I was told last week it was out of guarantee and they would not replace it I would have not paid £10 to send it to them.

    Surely an iron should last longer than 11 months and when I got the 2nd iron from them it had the guarantee card in the box????

    The manufacturer is right, the guarantee runs from the purchase of your first iron which is 2 years ago.

    As to how long you expect it to last this obviously depends on how much you have used it in the 2 years. They seem to have made you a generous offer for a new iron. Accept it.

    For Christmas my mum bought me a digital camera, and not just any camera the one I really really wanted however upon opening it in great excitement on Christmas day it would not work. Although this was a disappointment my mum said not to worry, its faulty and immediately emailed the site which she bought it from.
    To cut a long story short 3 weeks on the company says it was water damaged (by us) and that isn't covered by warranty and they won't do anything, despite my mum's efforts to explain its faulty, consumer rights etc.
    I feel very strongly about this injustice and so am willing to take it to the county court as a small claim, but just wondered whether there was any other alternative I could try first, or if you had any advice on proceeding with the court route?
    Any help would be appreciated! :-)

    Initially write to the supplier and tell him the full facts and state very clearly the damage was not caused by you. State that if the camera isn't replaced or a refund issued within 7 working days you will go to the Small Claims Court. Send your letter recorded delivery.

    If the camera was purchased using a credit card your card company is equally liable so send them a copy of your letter asking for their assistance.

    I assume the purchase was made in your mother's name so all dealings should be from her.

    I was wondering if anyone could give me some advice please.

    I purchased a Dell laptop, via their website, in December 2008 (13 months ago), I paid an £80 deposit on credit card and got a good deal on their finance over 3 years, therefore I am still paying for it. I also got a free 3 year warranty with the computer.

    Last week the hinge broke on opening the computer and it has started coming apart up the side of the screen. It doesn't get abused and is in a generally good condition.

    I rang them today and told them of the problems and they have said that wear and tear is only covered for 6 months after purchase. I spoke to the supervisor and quoted the sale of goods act specifically 'The quality of the goods includes their state and condition including their appearance and finish, freedom from minor defects, safety and durability.'

    I said that if you are selling the computer with a 3 year warranty and are financing it over 3 years then 13 months seems unreasonable for it to be falling apart and as a reasonable person this would seem to be in a period that you would not expect it to fall apart.

    They have said that it's not covered and there is nothing they can do. At my request they have taken my number and are getting their legal department to call me back on monday.

    Does my argument sound reasonable and what should I say when they call on monday.

    Any help muchly appreciated. :confused:
