I think everyone gets the jist,
Equally; - in an equal manner, alike, impartially
Jointly; - in a joint manner, together, unitedly, in concert.
No need to be so damned pedantic, the point I was making is still valid, the difference,(not worthwhile), was not worth making the post for, but then I know your agenda!
Its not pedantic at all.
It is "joint and several liability". In law, this means that remedies are available against both parties or one or the other.
Equal liability is different. It means that teh SAME remedies are available against both parties. This is not right in this case. The same remedies (e.g. specific performance) would not be available against a credit card provider.
You don't know my "agenda" or indeed anything else about me. So lets keep it on topic ok?0 -
Worth trying LG to see if they will help as a goodwill gesture but they have no legal responsibility.
Regards,
Art.
LG will almost certainly have included a 1 year manufacturer warranty the poster could claim on.
Possibly longer
Also as said a credit card company would have an equal liability under the SOGA for the fault this time but probably not the 3 year extended warranty.0 -

Careful, you will incite Tozer, it is "jointly" you know, not equally!:D. see post #2335
But he probably won't bother, it is just me he has an issue with.Don`t steal - the Government doesn`t like the competition0 -
Why does tozer have an issue with you?
You always offer sound advice to posters.

re: the 'feud' between derrick & tozer.
I'm sure I speak for many of the people who use this thread ( I've been reading it since I got some advice from Art).
If I'd studied law I would not need to ask for advice.
As I haven't studied law Not "equally" but "jointly and severally" liable. exact terminology doesn't mean a lot to me.
I'm just thankful for the advice.

If anyone thinks I have a 'feud' against Derrick, they are mistaken. Much of what he says is very good.
Occasionally, he misleads. And I correct it. I find it regrettable that he cannot accept the correction with good grace.
For the avoidance of doubt, there is a distinction between "equal" and "joint". Derrick knows this.
Anyway, enough on the subject.0 -

Please could someone help? I bought an LG LCD TV from Empire Direct on 28/12/08 with a 3 year extended warranty, as Empire has now gone bust what can I do? My TV started with an intermittent fault in March where it loses sound and picture, but is now happening nearly daily. Do I have a claim under the sale of goods act? What should I do? Its only 19 months old and paid over £700!!!
Thanks
Jay

I believe I have the same tv as Jay because its got exactly the same problem (32lt75), as it seems to be a faulty product. I did not purchase an extended warranty, however I did point out the problem during the warranty period to LG who then fobbed me off by saying it must be my weak signal strength. Now outside the 1 year warranty period, after trying several different aerials in different locations and hearing from the many people like me and Jay, I've found it is a problem with the set which can be solved by a firmware update. Where do I stand with getting LG to do the firmware update at no cost to me?
Help much appreciated from the wise heads in this forum.
Couple of things - can you prove that you pointed out the problem?
When did you buy it? How did you pay for it? Credit card?0
