    If the item does not comply with the description then it contravenes section 13 Sale of Goods Act 1979. Issuing small claims is dead easy.

    Right got news on my issue, the vouchers have been calculated at £600

    now because this write off is due to an overdue repair deadline and is covered by my coverplan, the vouchers are meant to be able to buy me a laptop of the same spec of better and for this i required £900

    so after much arguing over specs i finally got my way, just waiting for them now.

    Hi,

    I bought a Samsung 42" palsma in Setember 2007 from Comet and today it has stopped working. I contacted their customer services and because the year had expired I was not now covered for parts and labour.

    A call charge has cost me £29 and labour&parts will start at £44 when the find out what the problem is.

    Could anybody give me some advise or guidedance on what to do next - i'm not happy at all about paying these charges for the price I paid for the plasma and from a well know company like Comets.:confused:

    Yes they are well know alright, for not being customer friendly.

    You could still have rights under SoGA, as you can bring a claim against the RETAILER for up to 6 years after purchase, a 42" plasma should last longer than 17 months,(how much did it cost?), see BERR; -

    "Q3. Are all goods supposed to last six (or five) years?

    No, that is the limit for bringing a court case in England and Wales (five years from the time of discovery in Scotland's case). An item only needs to last as long as it is reasonable to expect it to, taking into account all the factors. An oil filter would usually not last longer than a year but that would not mean it was unsatisfactory."






    From WHICH; -
    When you buy goods you enter into a contract with the seller of those goods. Under the Sale of Goods Act 1979 goods must be:
    • 'as described',
    • 'of satisfactory quality', and
    • 'fit for purpose' – this means both their everyday purpose, and also any specific purpose that you agreed with the seller (for example, if you specifically asked for a printer that would be compatible with your computer)."
    I suggest you go back to Comet and tell them you are claiming under SoGA as you feel the tv is not "of satisfactory quality" or "fit for purpose" as mentioned under the SoGA. and that you want back the £29. it has already cost you.


    Did you pay, (any amount), on a Credit Card? If so you have the same rights/claim against the CC company.

    Hi all

    My dell laptop has conked out just outside of its one year warranty (which ran out Jan 2009). After going through diagnostics Dell have told me its most likely the graphics card which is faulty, and as its built in to the motherboard, the whole motherboard will need replacing, at a cost of £280. They hinted they may give me 30% discount - making the total £200. I still think this is too expensive and its probably cheaper me getting another new laptop for around £350 - £400.

    Before I go down the 'new laptop' route, have i got any arguments i can put forward to Dell about getting this repaired for free, or cheaper? The laptop was bought in Jan 2008 so has lasted just over a year. Can I argue that equipment like this is expected to have lasted longer?

    well forget about talking to dell, ring who you bought the laptop from, your argument is with them.

    how much was the laptop? (this will strengthen your argument if it was a more expensive model but dont dispear if it was cheap!)

    to put it short, yes you do have an argument (with the retailer not dell) under section 14 of the sale of goods act that the goods are not of satisfactory quality. SOGA gives you up to 6 years (5 in scotland) protection, but this is variable and entirely depends on cost etc.

    also how did you pay for the laptop, if by credit card then the credit company are jointly liable and you have further protection.

    post back the info i asked and anything else and i will reply to you with more info on what to do next as to not over bear you, im sure others will be along too to help.

    If you try to go down the line of unsatisfactory quality you will need to prove it with an engineers report after 16 months of satisfactory use.

    The best bet initially is to go back to Dell and see if they will increase their offer to you.

    surely an engineers report would cost no more than 100 in my experience so isnt that the cheaper route? rather than a 200 pound repair.
