Firstly, you need to talk to your repairer and ask him what he said to Empire. If they are correct then you have little else you can do. If the repairer didn't blame 'wear and tear' then I would suggest a strong letter to Empire and tell them that if they don't settle your claim within 10 days you will go to the Small Claims Court.
It would be a good idea to get something in writing from the repairer.

The Engineer says Empire asked him if the fault was there when the TV was purchased - they're back on the prove an inherent fault aspect again - he said he couldn't say, they then asked if the fault was common and he said in his experience it was but did not say anything about fair wear & tear.
Unfortunately he now says he can't get involved any further for fear of upsetting Sony0 -

Sounds like Empire are not being totally honest with you on their conversation with the repairer. I would suggest the same course of action I mentioned earlier - a letter to Empire and if this doesn't get a result then go to the Small Claim Court.

Have written again - also spoke to Credit Card Co. - they say they get the impression Empire are trying to grind me down and hope i give up - they want more time to pressure them to settle after which they will make a commercial decision as whether they will settle in some way or await Court Action - wioll keep you posted & thanks for all the advice and encouragement.0 -
Query please with regards a Hewlett Packard laptop..........I purchased this laptop in January 2007 and had to have it exchanged for a new one in the first two weeks because of a fault. This January, however, I came to turn it on one morning and it was dead.....nothing, zilch activity......The easiest thing for me is to take it into the local computer guy to have a look at and he said to us that the problem is to do with the Motherboard, it is a common problem and that we should contact Hewlett Packard direct...............We have done this. They basically said 1, its out of the 1 year warranty and 2, we cant find the receipt......so they wont do a thing. I am so upset by this. It cost me a lot of money which took me ages to save. I cant afford a new one. Do I have any kind of claim? And would that be with Curry's or Hewlett Packard directly?.....Thanks0

Firstly, your contract is with Curry's and not Hewlett Packard. Go back to Curry's and tell them there is an inherent fault with the laptop and you want a replacement, repair or refund. They will tell you the laptop is out of its 1 year warranty but don't be put off by this. Tell them they are still responsible under the Sale of Goods Act and if they don't deal with your problem satisfactorily you will go to the Small Claims Court.
As the laptop is more than 6 months old you may be asked to prove it has an inherent fault. To do this you will need an engineer's report and a letter stating that the fault is a common one.
If you paid for the laptop with a credit card write to your card provider telling them they are also liable and ask them to get involved.
If you are asked for proof of purchase you don't necessarily need to produce the original receipt. An entry on a credit card statement or a bank statement is proof enough.

I have had so much trouble with elephant car insurance renewing this year. they messed up my renewal, therefore i had to get a 'new customer' quote for this years insurance. 3 times i rang them to check that only 1 payment would come out but much to my anger it seems they have taken 2 lots of payment :mad: :mad: :mad:
Basically can i reclaim the bank charges from a legal point of view, from them as they have now made me go over my overdraft limit :mad: :mad:0 -

How many payments did you owe them?
If the money was taken by direct debit talk to your bank and complain. They have to rectify the situation for you.
As to the bank charges you may be entitled to reclaiming these but it depends on the circumstances. If they were simply playing 'catch-up' you are not going to get anywhere. If they took more than they should have then write to their MD asking for compensation.

Hi, I pay yearly so there should of been 1 payment of £460 come out from the new policy i set up with them. I triple checked they had cancelled the 'renewal' that is supposed to automatically come out unless you tell them otherwise, maybe 3 times was not enough for them :rolleyes:0
